(SUSPENSION DE LA S~ANCE POUR QUELQUES MINUTES) REPRISE DE LA SEANCE Me IRVING: My Lord, my friend has argued over almost a full day on a wide range of issues, and has drawn the Court's attention to a large number of cases. I will try to reply as briefly and coherently as I can. In doing so, I will not necessarily follow the order of presentation taken by Mr. Joyal. Let me start, if I may, with something that was said just in the last few minutes. My friend was referring to the article by Mr. Binette, and if I have it correctly, he was referring to page 963. I'm not going to read these out again to the Court, My Lord. But the thesis he was advancing was that the law of evidence can't deal with these issues, that somehow, for some reason, which I must say escapes me, the theory which Dr. Warner puts forward in this book is something AUDIOTRANSCRIPT, Divi,ion de Pierre Viloire & Associ~, Lt4e

We know now, My Lord, that Mr. Joyal and Mr. Baker, that our friends propose to put in only the book by Dr. Warner, and the report of the Royal Society on Addiction, in addition to those materials which are already listed in their Rule 15. I'm just going to stick with Dr. Warner for the moment. Effectively, the Court is being told that the Warner opinions which are expressed in the book "Selling Smoke" are somehow of a nature that the ordinary Rules of Evidence won't deal with it. Well, My Lord, that's simply not true, and there is nothing in the world to stop Dr. Warner from coming and testifying before the Court like any other expert witness. As you know, from the Affidavit, in fact, it was proposed by the Attorney General that he should be a witness. We have not been told why he is not here. We have no idea why he couldn't come, or wouldn't come. But there is nothing -- there is nothing at all to suggest that this is a matter of such complexity or difficulty that Dr. Warner couldn't come like the other witnesses and give his evidence under oath in Court, so that he could be cross-examined. He said it is not up to the Crown to prove that the abolition of Canadian advertising is going to have any effect on consumption, but only to show the Court there is some rational connection between the advertising ban and the object of the Law. Now, I don't agree with that proposition, but if that is the view the Attorney General of Canada takes, then in their final argument, no doubt, they will say -- we were not required to prove any, by any direct evidence, that banning advertising would have any effect on the consumption of tobacco in Canada, but merely to point out to the Court that there is some reason to believe it. But that has no bearing on the issue which is now before you. That is simply a matter of final argument. If my friends don't think they have to make that evidence. Then, of course, they won't make it. But it has nothing to do with the evidenciary value of a book of this kind now being offered as extrinsic evidence.
