544 4 i0 15 20 25 Mr. Irving saying that we were trying to drag RJR MacDonald into. the debate with Imperial before the Court of Appeal. That problem has long since been resolved. He said that the two (2) cases can't be joined because they were both not ready or in the same state of readiness which was the foundation, of course, as you know, of your own judgement. That no longer obtains, there is nothing in Appeal and both cases are equally ready. The third reason he gave, which you resumed at page 9 of your judgement, was that they were simply trying to stall the hearing of the two (2) cases. We're ready to proceed with both cases on Monday, My Lord. At page 12 of your judgement, you found that it was your inclination not to grant the motion "Ace stage"... "~ ce stade", and for the reason that they were both not ready. The law in 271 gives you a certain amount of discretion and latitude as you well know. The cases that you'll find in the black book, particularly Katz number 2, Silberstein in number 5, contained -- or any of the other cases -- contain anything particularly unique or unusual save, as you know, to support the proposition in 271 and the theories behind it.
