WHO, after having been duly sworn in, doth
depose and say as follows:-

Q. Mr. Collishaw, I think the record should
show that at the request of your counsel I'm going to
ask you questions in English although the affidavit you
wrote is in French. A. Fine.
Q. Do you have the affidavit in f~ont of you?
A. Yes, I do.

Q. Who wrote it?
A. It was written largely by one of my lawyers.
Although I read French and I speak French quite fluently,
it's just that I preferred to work in English.
Q. Now, you say in Paragraph 2 of the affidavit
that you were responsible for the.., let us call it Bill
C-51.
A. Yes. Insofar as the work of civil servants
is involved in the preparation of the Bill, I had the
subject matter responsibility in the Department of Health
and Welfare.
Q. That goes back quite a long way I think,
doesn't it?
A. Yes. Well, all matters pertaining to legis-
lation and similar subjects that fall within the responsi-
bilities of the tobacco products... I'm Chief of the
Tobacco Products and the Tobacco Products Unit is responsible
for subject matter questions concerning legislative matters
concerning Tobacco, and as such, I've been involved with
the preparation of the Tobacco Products Control Ac~.
Q. Which is what I referred to as...
A. As Bill C-51.
Q. And I suggest for convenience we just refer
to Bill C-51, if that's all right, Mr. Collishaw.
A. All right, if you wish.
Q. Simply for the purpose of the Examination.
Now, since Bill C-51 has been passed, what responsibilities
have you had?
A. Again, the responsibilities have pertained
to implementation of the legislation. I've been involved
in consulting with my colleagues about regulations to
be developed under the Bill, I've been involved with
the Department of Justice in preparing responses to the
legal actions that have been brought against the Bill,
and making plans for administration of the Bill generally.
Q. You say in conjunction with the Department
of Justice. Is it your evidence that somebody in the
Justice Department in Ottawa is also responsible with
you for the preparation of the cases now pending in Court?
A. I'm sure you know that in the public service
many people get involved in things like the preparation
of legislation and the preparation of defenses, of challenges

to legislation, and sure, all the lawyers in the Federal
Government work in the Department of Justice, so it's
natural that they would be involved.
Q. Let me preface my question by saying:
When I read your affidavit it appears that you are solely
responsible for finding witnesses and so on. My question
is: Are there not members of the Department of Justice
in Ottawa as well who are working on the defense to the
Court challenges against Bill C-517
A. I believe there is one member of the Department
of Justice in Ottawa working on defense, yes.
Q. And has that person been working on it
from the outset as far as you know?
A. Well, it's difficult to know where the
outset is. There have been three challenges filed.
To which one are you referring?
Q. Let's start with the first one.
A. Okay.
Q. The statement of claim in the Rothmans
action was, in fact, served on July 20th...
A. Yes.
Q .... 1988. When were you made aware of
that?
A. At that time I was on holidays and I heard
it on radio, read it in the newspaper while I was at
my cottage.
Q. I see. When did you return from holidays?
A. It would have been the first week of August.
Q. Now, as far as you know, are there individuals
in the Department of Justice who are also working on
that case in preparing evidence to support the Government's
position?
BY MAITRE ROGER BAKER:
I wonder what the relevance of the Department
of Justice lawyers working on the Rothmans case is to
the case presently before the Quebec Courts.
BY MAITRE IRVING:
I thought it was obvious. I simply want to
know if Mr. Collishaw knows who in the Department of

Justice has been involved in getting evidence together
to meet the challenge launched first by Rothmans -- if
he knows.
BY MAITRE BAKER:
Well, perhaps you should ask Mr. Collishaw,
given that he's testifying on his own affidavit and the
affidavit does say certain things, Mr. Irving, test the
veracity of the affidavit on what he has done, not what
members of the Department of Justice have done in terms
of evidence gathering.
BY MAITRE IRVING:
Well, I want to know whether people in the
Department of Justice are also working on the matter.
If you're going to direct the witness not to answer,
Mr. Baker, go ahead. I think it is entirely relevant.
BY MAITRE BAKER:
You haven't indicated that it's relevant or
what the relevancy is.
BY MAITRE IRVING:
I think I have. I've said that this affidavit...
in reading the affidavit, it's not clear that anyone,
other than Mr. Collishaw, has the responsibility of finding
witnesses, preparing evidence and, generally, preparing
for a defense of Bill C-51. My question is: Is it not
true that there are people in the Department of Justice,
apart from Mr. Collishaw who is in Health and Welfare,
who have been working since -- for the moment I ask --
who have been working since July 20th of 1988 on this
very issue. If Mr. Collishaw doesn't know, he can saw
he doesn't know.
BY MAITRE BAKER:
But, Mr. Irving, you have asked really two
questions in one. Are you talking about exclusively
