I provided in paragraph (1), to any person other than those
2 authorized by the Secretary in carrying out trieir officiai
3 duties under this section.
4 "(B) Subpacaaraph (A) does not authorize the
5 withholding of a list provided under subsection (a) from any
-.5 duly authorized subcommittee or committee of the Ccngress,
7 except that if a subcommittee or committee of the Congress
S requests the Secretary to provide it such a list, the
9 Secretary shall notify the person who provided the list of
13 such request and shall make the list available to the
11 subcommittee or committee in accordance with such Frecedures
12 as the Secretary shall establish to assure that the
13 confidentiality of the list is protected.
14 "(C) with cespect to any inf-ormation--provided to the
15 Secretary under subsection (a), the Secretary shall
16 designate a duly authorized agent to serve as custodian of

3 Miscellaneous Amendments
4 Sec. 6. (a) Paragraph (1) of section 2 of the Federal
5 Cigarette Labeling and Advertising Act (15 U.S.C. 1331) is
6 amended to read as follows:
7 "(1) the public may be adequately informed about
8 the adverse health effects of cigarette smoking by
inclusion of specific warnings on each package of

ciaarettes and in each advertisement of ciaarettes.".
11 (b) Section 3 of such Act (15 U.S.C. 1332) is amended bv
12 addinq at the end the following:
13 "(8) The term "Secretary' means the Secretacy of
14 Health and Human Services. ".
15 (c) Section 8 of such Act (15 U.S.C. 1336) (as so
16 redesignated) is amended to read as follows:
17 ' "Federa]. Trade Commission
18 " Sec. 8. Nothing in this Ac:t (other than the
19 zPquirements of section 4(b)) shall be construed tc Iy;rit,
2^ restrict, expana, or otherwise affect the authority of the
21 Federal "'rade Com~rissicn c:ith respect to unfair or deceptive
22 acts or practices in the advertising of cigarettes. ".
23 (d ) Section 9 of such Ac*_ (15 U. S. C. 1337) (as sO
