Chairman Bergson called the meeting to order at 10:20 a.m. in the offices of The Tobacco Institute. Mr. Ainsworth was the other committee member present. Messrs. Cherry, Mott, Smith and Wells were unable to attend. Also in attendance were Ms. Ellen Agress, Lorillard; Messrs. Irish and Kochevar, Philip Morris; Mr. Haley, industry consultant; Mr. O'Flaherty, industry counsellor; Mr. Rupp, Covington and Burling; Mr. Chilcote, TI President, and Messrs. Buckley, Cannell, Lewis, Marshall, and Mozingo of The Institute staff. The minutes from the meeting of December 6, 1985 were approved. POLICY QUESTIONS After discussion of the proposed Alabama uniform state tax, it was agreed that each company would communicate its position on the legislation to The Institute by February 14. Mr. Marshall reported on the current situation in Colorado regarding the smoking restriction'legislation and possible initiative campaign. No change in policy was recommended~by staff or by the committee. Clove cigarette ban legislation pending in Maryland, Missouri and Ohio was reviewed by Mr. Mozingo. The committee once again reaffirmed industry policy regarding clove legislation. Mr. Mozingo outlined current industry approach to smokeless "warning" label legislation. The committee encouraged regular communication with the Smokeless Tobacco Council.

Following Mr. Rupp's review of product liability reform legislation, the committee consensus was that staff continue to monitor and report on legislative activity and that the TI Committee of Counsel establish policy guidelines. Staff will increase reporting capabilities on this issue. The Policy Committee agreed that the industry should oppose initiative and referendum enabling legislation. Staff will recommend appropriate industry involvement in the New Jersey situation; staff will contact the National Center for Initiative Review for additional support. FEDERAL LEGISLATION Mr. Lewis reported on pending, or likely to be considered~, industry issues in Congress, including advertising bans, limit on advertising deductibility, smokeless "warning" labels, FET sunset status, commissary cigarette sales price differential and smoking restriction legislation. He also reviewed the recent NAS hearings. STATE/LOCAL LEGISLATIVE UPDATE Messrs. Buckley and Marshall reviewed the status of key industry legislation in several states, including New Mexico, New York, Ohio and Washington. Legislative successes in California, Indiana and West Virginia were also reported. Mr. Mozingo emphasized the necessity for, and importance of, coordination of industry activity in states where various industry trade associations and TI member companies have each retained state counsel.
