Brown & Williamson Tobacco Corp. v. Plitt Theaters Inc.
(Advertising, GA Superior Ct.)This advertising suit was brought by Brown & Williamson Tobacco Corp. against Plitt Theaters, and Plitt Southern Theaters.
On November 15, 1982, the parties executed a contract to show commercials for the plaintiff's tobacco products in the defendants' theaters. The defendant ran a trailer prior to a showing of Disney's Snow White and the Seven Dwarves, pursuant to the parties' agreement. This began a grass-roots movement against such advertising, sponsered in large part by Group Against Smoke Pollution (GASP). On March 21, 1984, the plaintiffs gave notice of their intent to terminate that contract.
The case was heard in the Superior Court of the De Kals County, State of Georgia (Civil Action No. 84-2795-5).
