(ETS MS Cir. Ct. 1994 Def. Verdict)This individual second-hand smoke personal injury suit was brought by Ava Dean Butler as Executrix of Burl Butler's estate against Philip Morris, Brown & Williamson, R.J. Reynolds, Liggett, American Brands, American Tobacco Co. and Lorillard on May 5, 1994.
The case was heard before the Circuit Court for the Second Judicial District of Jones County Mississippi (Civil Action No. 94-5-53) by the Honorable Robert G. Evans. The jury returned a verdict for the defense on June 2, 1999. No appeal was filed.
