Browner v. R.J. Reynolds Tobacco Co.

(Personal Injury CA Superior Ct. 1981) Considered the first suit in the second wave of tobacco litigation

This personal injury suit was brought by Flora Mae Browner against R.J. Reynolds, and Johns-Manville in 1981.
The defense argued that smoking had not been established scientifically as causing any human disease, but that the plaintiff assumed any risk by choosing to smoke in light of warnings and common knowledge of the dangers of smoking.
The case was heard in the Superior Court of the State of California for the County of Contra Costa (No. 86692A).
