PlaintiffLawrence Garfinkle was an American Cancer Society official. He did a study which disputed a "Japanese Study" of early 1980s that concluded nonsmoking wives of smokers had a higher cancer rate than the smoking husbands (E. Whelan 1984). In an early 1980s ad, R.J. Reynolds Tobacco Company quoted Garfinkle, out of context, to attempt to prove that passive smoking is not an important health-policy issue. Garfinkle protested by letter to the N.Y. Times (L. White, Merchants 1988).
