CIGARETTE PACKET WITH OVAL BASE SURFACE. Norwegian Design
Appl. No. 68725 - FTR0071. After receipt of another
official action, a corrected set of drawings was prepared by
our attorneys ABITZ et al and approved by the inventor. They
will now be filed in the Norwegian Patent Office.
HEXAGONAL CIGARETTE PACKET. US Design Serial No. 07/166 151
- FfiR0078. The recorded assignment and a copy of the notice
of recordation issued by the USPO; stating that the
assignment has been recorded as of 10th March, 1988, was
received.
HINGED LID CIGARETPE PACKET WITH OVAL BASE SURFACE - FTR0085.
Following communication with Mr. LEE POLLAK and Mr. ARTHUR
PALMER, Instructions were given to REDDIE & GROSE (R&G) to
file this application in Australia in addition to the other
countries mentioned in last months report. OVAL CIGARETTE
PACKET MACHINERY. it is planned to manufacture this product
in PMG-Munich for export to France. In order to have an
overview with respect to the possibilities of filing a
process patent for the above packet, instructions were given
to R&G to initiate freedom-to-use searches in France and

Germany. The design application(s) match the current
product design.
CARTON DISPLAY DEVICE - FTR0087, FTROO88, FTR0089. After
discussion between Mr. J.-M. TOINET (EEMA) and Dr. PETER
MARTIN (S&T) and upon advice of Mr. J.H. BASS (R&G), three
applications (two design applications and one patent
application) were filed on 14th Decem.ber, 1988, in the
British Patent Office in order to obtain an early priority
date. The invention consists of a carton blank design that
allows the carton to be hung on a wall so that one or two
packs can be removed either from the front or the side of the
display carton. Both versions of the blank incorporate a
hanging tab in the rear panel but the patent application
(drafted around both design drawings) describes in words the
alternative use of adhesive strips or velcro pads.
APPARATUS FOR STAMPING OPEN CHANNELS IN THE PERIPHERY OF
FILTER PORTIONS. European Patent Appl. No. 82300636.6 -
FTR1034. A translation of this European Patent has been
filed in the Dutch Patent Office and the publication fee has
been paid.
CHANNELED CIGARETTE FILTER (BARCLAY). BROWN & WILLIAMSON
TOBACCO CORP. (B&W). Swedish Patent Appi. No. 8002712. As
requested by the examiner of the Swedish patent office, the
English translation of the Jenssen report has been forwarded
to her via R&G. Finnish Patent Appl. No. 801127. Upon
receipt of an official letter from the Swedish Patent Office,
R&G forwarded, along with other papers, a copy of the German
BGH (Bundesgerichtshof) decision (which was not available
when papers were filed last in the Finnish Patent Office)
together with Swedish official letter to our Finnish
associates for filing in the Finnish Patent Office. The
Finnish appeal against rejection of our opposition has been

in abeyance since February 1987, when B&W filed a response to
our appeal. The backlog of appeal hearings in Finland is
some two to three years.
Monday 5th : HER - Took part in the meeting of the CORESTA Task
Force "Sidestream and Environmental Tobacco Smoke Analysis" in
Geneva. Presentations were given on the following topics .
(1)-Influence of the flow pattern on the trapping efficacy of
sidestream components (J.-J. PIADE). (2)-The BAT sidestream
apparatus (HOLLWEG). (3)-CO concentrations in the sidestream of
different cigarette types (GONZALES). (4)-Lighting of
cigarettes for sidestream analysis (NALL). Mr. DENNIS ALLMAN,
FILTRONA wanted to speed up matters and proposed to construct a
"CORESTA-adopted" sidestream apparatus, but the common opinion of
the Task Force was that more information (and practical
experiments) about some critical parameters would be needed
beforehand. The principal problem of sidestream collection is
that (a) the cigarette should burn freely, but (b) the smoke and
gas phase, once produced, should be quantitatively collected by a
chimney-like device with the f low directed upwards.
Tuesday 6th : HGA - Meeting at Brillancourt with Corporate
Affairs EEC on the subject of the US Surgeon General's Report
1989, which is expected to deal with tobacco ingredients. Based
on past experience, we do not expect this subject to'become a
critical issue in Europe. The reason being that ingredients are
regulated in some leading countries and that these regulations
are taken by Industry as guidelines for the rest of Europe. The
documentation available in S&T covers historic lists of
ingredients, including specific recipes (all published
documents), literature on relevant technology in the widest
sense, including patents (flavourants, casings, processing aids,
pesticides, etc), scientific literature (chemistry, toxicology,

etc.) and national regulations (laws, decrees, other
regulations).
Wednesday 7th : HGA / IAM / PEM / HER - Meeting in Neuchatel with
Messrs. PANTET and CRETTAZ on the subject of ETS / IAQ. HGA
explained that one of ARIA's key consultants, Mr. FRANK LUNAU,
was briefed on the Swi.ss situation and that HGA had already
invited him (as well as Mr. C. LISTER, C&B) to come to Neuchatel.
In practical terms, S&T would like to set up a group of experts
for Switzerland, composed of consultants, under the guidance of
Mr. LUNAU, coordinated by Mr. LISTER, and paid for by the ASFC.
This group of consultants will formulate technical arguments
which can serve as the base for the Industry messages. At the
same time, the group will become involved with the experimental
work carried out by BATTELLE, Geneva. For the time being,
BATTELLE are in the process of winding up the preparatory phase
and will submit the proposal for the continuation of the
monitoring work within days. Following the lead given by Mr.
DISERENS, BATTELLE are getting ready to make measurements at
workplaces, in particular, offices. Mr. PANTET was asked to
provide S&T with the names of possible agencies that could be
used to establish a representative sampling grid (base for the
sampling plan), needed to make such a study representative for
the whole country. HGA made it clear that the YES/NO decision
on the BATTELLE proposal will have to be taken by mid-January,
regardless as to whether or not the members of the ASFC have made
up their minds.
Thursday 8th . HGA / IAM / PEM : Meeting of the Research
Committee of the TAC. S&T was strongly represented, the reason
being that, for the time being, IAM will continue to be the
substitute delegate for PM and eventually PEM will replace HGA
and IAM. The following items are of interest (1) -TAC has to

stay neutral in the testing conflict (BSI vote in ISO). (2)-The
Research Committee will be renamed Scientific Committee and do
more work (less delegation to sub-committees). (3)-All
sub-committees, with the exception of the nicotine/tar working
group, have been abolished with immediate effect. (4) -HGA was
asked to outline, once again, the ARIA-related ETS/IAQ concept.
The other companies showed real interest and agreed that HGA
should bring Drs. LESLIE and ROE ta the next meeting. (5)-D.
BACKHURST announced that the current Sales-Weighted Average Tar,
SWAT, has reached 13.2 mg. This has brought the tar ceiling for
the introduction of new products down to 14.3 mg. The values for
SWAN and SWACO given by D. BACR.HURST were 1.19 mg and 14.3 mg
respectively.
Friday 9th : HGA - Meeting with Messrs. ROBINSON, REARDON and
MAEDER on the ingredients issue in general, and the specific
issue in Finland. HGA listed the documentation and arguments
available, explained the industry's record of integrity,
responsibility and constructive cooperation with regulating
authorities in some leading countries. As a result, a letter
was drafted for management approval which could be addressed
either on behalf of the Finnish Industry or, failing Industry
unity, by PM and AMER, to the Finnish Medical Board or the
Finnish Government Authorities. HER - Visited the FRESENIUS
Institute, Taunusstein, FRG, in order to discuss the ongoing
preparation for indoor air quality measurements. Two sets of
instruments have been prepared so far : (1)-An ultra precise set
of portable (but unobtrusive) instruments, mounted on a 19" rack.
(2)-A portable and unobtrusive set of miniaturised instruments
packed into a briefcase. The first set contains instruments for
(a)-counting and separating RSP's according to diameter from 0.5
- 10 micrometer into six classes, as well as collecting them on a
filter, (b)-Measuring C02, by IR absorbance, at concentrations
from about 300 ppm (outside) up to 10'000 ppm and (c)-Measuring

CO, by IR absorbance,at concentrations from about 0,2 ppm to 50
ppm. Nicotine is collected in the usual way by absorption tubes
and determined by GC. The briefcase sampler monitors (a)-CO (an
improved electrochemical cell which includes a clean-up stage
that prevents cross sensitivity with alcohol and other
compounds). (b)-Barometri.c pressure. (c) -Relative humidity.
All data are stored on a data logger. Independent electronic
timers control up to five sampling systems for CO2. The
sensitivity of the nicotine determination is greatly increased,
which means that the sampling time is reduced to 15-20 minutes.
Another timer activates a sampling device for micro-organisms.
The plans for the immediate future are to test the instruments
and to cross-check with Neuchatel. In the meanwhile, FRESENIUS
is going to try under his own initiative to find "clients",
according to the ACVA pattern, who are interested in indoor air
quality studies (diagnoses) being made of their premises.
Monday 12th : HGA - Visit to Neuchatel of Professor GIUSEPPE LO
JACONO, of the Department of Hygiene, University of Perugia, who
is also journalistically active. The Professor has good
contacts with the WHO in Geneva and also the IARC in Lyon. He
knows both Dr. NAKASHIMA, the General Director of the WHO and
Professor TOMATIS, the Director of the IARC, in person. The
discussion was very interesting as Professor LO JACONO considers
"addiction" and "involuntary smoking" to be key issues, and he
disagrees with the positions taken by the US Surgeon General on
both of these issues. The professor was given some literature
references and it was agreed to keep up the contact. IAM / PIC :
Attended a meeting with Messrs. J.B. BODER, J. ZUBER, F. SENEHI,
E. ERKOHEN and two delegates from the Turkish Standardisation
Institute (TSE), Mr. L. SEN and Mr. F. ARSLAN, to discuss and tc
inform them on the channel ventilated cigarettes issue in view of
the Turkish vote to ISO/TC126.

Tuesday 13th : HER - Visit to Neuchatel of Dr. TAGE VOSS,
Denmark, who outlined his plans for publishing articles as well
as his plans for TV programmes over the next few months. TAGE
VOSS' preferred theme is freedom of choice and "savoir vivre".
Both themes are very popular with the Danes as his fan-mail
proves. We are continuing to supply him with literature
references. He also wants to translate TOLLISON's book
"Clearing the Air" into Danish, including three chapters
tailor-made for the Danish public.
Wednesday 14th : HGA / IAM / HER / PEM - Meeting in Neuchatel
with Messrs. FRANK LUNAU, CHARLES LISTER, ULRICH CRETTAZ, RAYMOND
PANTET and JEAN BESQUES. The purpose of the meeting was to
develop a plan of action designed to achieve the elimination of
the article concerning the ban on smoking in the workplace from
the Swiss Draft Ordinance on Occupational Hygiene. It was
agreed that .(1)-FRANK LUNAU, CHUCK LISTER and HGA are to
assemble a group of experts who will have the task of compiling a
set of arguments/messages which the Swiss Industry can bring to
the attention of the Authorities. The work of the group will
not involve any presentations to third parties. (2)-ACVA is to
be asked to carry-out, before the end of February 1989, an IAQ
survey of 20 office sites in Switzerland. (3)-Mr. PANTET and
HGA are to cooperate in finding these sites by mid-January 1989.
(4)-BATTELLE Geneva will continue to be involved, with a medium
term goal of carrying out a representative IAQ survey in
Switzerland. PIC / ANB - Visit to VTT Helsinki (Technical
Research Centre of Finland) and meeting with Dr. K. HIMBERG and
Mr. V. VMTAINEN, Prof. MALKKI's co-workers, to improve VTT's
expertise concerning testing methods. Another purpose of this
visit was to cultivate the relationship of trust which has been
built-up over the years.

Thursday l5th : HER / PEM - Working session in Delft with J. VAN
DER WAL on analysing the results of the SAS In-flight Study.
None of the corrections changed the conclusions he had formed
from the study. The dependence of the concentration of
ETS-related compounds on the distance from the smoking section,
was dropped from the draft since there was essentially no
correlation and the number of cigarettes smoked was not included
in the analysis. On the other hand, a discussion of the impact
of smoking in the non-smoking section was added. There was
esentially no change in the statistics when these cases were
excluded. Another paragraph was added to explain the relatively
poor ventilation system in the DC9 aircraft (measured CO2 values
higher than anticipated), in particular aspects of
"short-circuiting" and the associated phenomenon of vortex
formation. The second draft of the report should reach the CIAR
before Christmas. The "addendum" requested by the CIAR, ie. the
UV-PM evaluation of the filter pads stored since September at TNO
was also discussed. Dr. BOSMAN, of the TNO Analytical
Department, was unhappy with the method provided by RJR and
suggested several improvements including measuring the UV
f luorescence rather than the absorption. This item was left
unresolved pending further discussions.
Friday 1.6th : HGA - Report by HER and PEM on the Delft meeting.
Decision by HGA to drop the UV-PM measurements. HER was asked
to communicate to Dr. BOSMAN that, in view of the long storage
time, the UV-PM measurements, which were scheduled to be run in
January 1989, should be cancelled as there is no guarantee that
the pads have not undergone any chemical changes. This has made
it unnecessary for Dr. BOSMAN to consider methods. HGA has
contacted Dr. OSDENE and asked him to inform the CIAR why the
decision has had to be made to cancel the W-PM measurements.
