Exhibit 10 * 471 AFFIDAVIT OF GERHARD N. SCHRAUZER, PH.D. STATE OF CALIFORNIA ) COUNTY OF SAN DIEGO ) ss.: 1. I am Professor of Chemistry at the University of California, San Diego. My research interests involve cancer prevention, particularly the role of trace minerals and environmental toxicants in human and animal disease. 2. I received my Ph.D. degree in chemistry from the University of Munich in 1956. I have authored 250 research publications and have edited two books. I am a member of the American College of Toxicology, the American Chemical Society, the Association of Clinical Scientists, the American Association for Cancer Research, the American Institute of Nutrition and the American College of Nutrition. I have organized three international conferences on the inorganic and nutritional aspects of cancer. 3. In my opinion the scientific evidence does not justify the conclusion that smoking causes lung cancer. Those who draw such a conclusion rely, in large part, upon epidemiological studies and ignore inconsistencies in the data. 4. Cancer is a very complex disease which is statistically associated with many factors. Some of these factors are familial predisposition, exposure to ionizing radiation (e.g. radon) or electromagnetic radiation, exposure to industrial carcinogens, exposure to viruses and other biological agents, diet, stress, and exogenous environmental factors.

I 5. My research in the area of dietary micronutrients and cancer, which has been cited by the Surgeon General of the United States, reinforces my opinion that there are many important factors related to the occurrence of cancer that have been largely neglected. 6. For example, the Finnish medical establishment is concerned about low levels of selenium in the Finnish diet, and about concomitant low selenium levels in the blood serum of the Finnish population. There is a growing body of evidence linking low levels of selenium in the blood and the later development of cancer. The linkage is particularly strong for respiratory tract cancer, which includes cancer of the larynx and lung. Serum selenium levels have been found to be unrelated to smoking. 7. In short, there remains a controversy in the scientific community as to whether smoking causes lung cancer. It is inaccurate to represent that science has conclusively resolved this complex issue. 10.
