This will respond to your recent correspondence, in which you repeat your request
on behalf of Liggett/13rooke for access to documents, Including those which you acknowledge
may be subject to various claims of privilege, and state that you regard any issue of our firm's
cost in addressing this request to be irrelevant because your firm and the Kasowitz fimt'Svill be
reviewing the doctunents for privilege purposes."
Your letter crossed my desk at the saame time as the Wal1 Street 7ou:nal of 3uly 21,
1998, which attributes a statement, at page $17, coL 5, to Mr. Kasowitz to the effect that your
client is committed to "nua over information and documents for use in suing" the companies
who arc srnoeg the privilege holders whose interests are implicated by your request. In light of
your client's apparent adversity to the privilege holders, it is difficult to understand how your
&rm and the Kasowitz firm can perforns the function of `4eviewing the documents for privilege

You also continue to ignore our request that your client reimbarse us for the
considerable cost to us of collecting the large number of files covered by your request and culling
from them the documents that are not covered by our attorney work product.

work necessary to retrieve the documents and prepare them for your review, consistent with the
preservation of all applicable privileges and protections, provided only that you pay us for the
