Debbie Knox, co-anchor:
Well, tobacco companies are being attacked at all
levels. Today, another state decided to file suit against
the tobacco industry over health care costs for smokers.
Mike Ahern, co-anchor:
Here in Marion County, a jury will be asked tomorrow
to decide if four tobacco giants are responsible for the
death of an Indianapolis man. News 8's Pam Kramer joins us
now with that story. Pam?
Pam Kramer reporting;
Mike and Debbie, as you know, there are warnings now
attached to cigarettes. Take a look at the billboard
behind me. Look closely. The warning addresses pregnant
women, but what about a man like Richard Rogers? He died
of lung cancer in 1987. He smoked most of his life, and
now his wife is suing four tobacco giants. (Visual of

Today, attorneys on both sides went over jury
instructions. Tomorrow they'll give their final arguments.
And then it will be up to a six-member jury to come up with
a verdict. Last year, a jury could not decide, so that's
why the case is being re-tried.
The suit alleges Philip Morris, American Tobacco
Company, R.J. Reynolds, and Liggett Group failed to warn
Rogers of the addictiveness of cigarettes. The cigarette
companies argue that there has been ample warning of the
risks tied to smoking tobacco products, and nicotine has
not been proven to be addictive, and if Rogers had wanted
to quit, he could have.
William Ohklemeyer (Philip Morris Attorney): If you are
aware of the risks that you are claiming are associated
with the use of a product, and perceive too in count of
those risks, then you can't hold the manufacturer of the
product liable for any injury that results from the use of

Kramer: We did try to get a comment from the atto=ey
representing the Roger's family, (but) he was not
available. Now this is not the first time a family has
taken on the tobacco companies. They have been in court
before but have yet to have to pay out any damages to
families or individuals, Mike and Debbie.
Knox; Yeah, Pam. Have you heard anything about having
to settle out of court in this case?
Kramer: No, we've not. As you know, there was a mis-trial
last year. Again it's being re-tried and we're told it
will go to the jury tomorrow afternoon, and then the jury
will be sequestered if it cannot reach a verdict by
tomorrow evening at some point. But as far as an out of
court settlement, no, no word on that.
