He was a heavy smoker, and he said he couldn't quit; but is that the fault of the tobacco companies? Eric Halvorson, co-anchor: Today a Marion County jury will be asked to decide if four cigarette manufacturers are responsible for the death of former Indianapolis attorney, Richard Rogers. News 8's Pam Kramer is covering final arguments and joins us now with the story. Pam. Pam Kramer reporting: Well, good afternoon Patty and Eric. Yes, the jury should start deliberating this afternoon. Final arguments are going on right now. Now Richard Rogers died of lung cancer in 1987. As you mentioned, he smoked most of his life. He was considered a heavy smoker, but he claims he could not stop, because he was addicted to the nicotine. Now his family'is suing four big tobacco companies: Phillip Morris, The American Tobacco Company, R.J. Reynolds, and Liggett Group. The Rogers' attorneys claim cigarettes are dangerous in their design, and they cause cancer, and the manufacturer should be responsible for Roger's death. Also they contend, there was not enough warning of the risks involved, But defense attorneys say the public knew of the risk even when Rogers was a child. They also say cigarettes are not unreasonably dangerous, and they claim Rogers could have stopped smoking if he had wanted to. I spoke with one of the defense attorneys before final arguments today.
