Our Sy Jenkins is at the City-County Building where the jury has been in deliberations now for over nine hours. Sy? Sy Jenkins, reporting: Well, Barb, this wrongful death lawsuit in which the Rogers are seeking unspecified damages has been in the hands of the jury, as you pointed out, for more than eight hours now. There's still no indication of any imminent verdict. The jury of five women and one man, including one smoker, this evening got little more than a hour dinner break from deliberations that started before one thirty this afternoon. They're trying to decided whether the nation's biggest tobacco companies are responsible for the death of Richard Rogers, an Indianapolis Attorney who died of lung cancer in 1987. Rogers' wife, Yvonne Rogers, claims his forty-five year addiction to cigarettes caused his death. But attorneys for R,J. Reynolds, Philip Morris, and two other cigarette manufacturers deny any responsibility. Disputing that it's ever been proven that smoking cigarettes causes lung cancer or is even addictive, one attorney told the jury, °cigarettes do not rob people of their free will", arguing that Richard Rogers could have stopped smoking at any time and for most of his life was aware of the reported dangers of smoking. But attorneys defending Rogers estate called the defense argument contradictory and that common sense tells you that cigarettes are a defective and unreasonably dangerous product. As one attorney for the plaintiff put it, "if you're at Churchhill Downs and hear hoof-beats, you don't think zebras."
