Phil Bremen, co-anchor: But tonight, an alternate juror says he would have voted the other way, would have held four big cigarette makers responsible for the cancer death of a lifelong smoker. That alternate spoke exclusively today to our Cullen Browder. Jim Bellows (Alternate Juror): I was there for a solid three weeks. Even though I was an alternate, I took seventy pages of personal notes ... Cullen Browder reporting: That said, Jim Bellows says he was surprised and depressed when he found out his colleagues decided in favor of the tobacco companies. Bellows: ...if it was me in that jury deliberating room, the very least that would have happened would have been the hung jury again. There would have been no way they could have turned my head. - Browder: But while making it clear they felt the tobacco companies were negligent for selling a deadly product, jurors considered Richard Rogers even more responsible for his decision to smoke. David Anderson (Jury Foreman): The only message I think I could give is if you think it's going to incur health problems for you, I think there's evidence there, and you'd be better off to quit. • VSDEO MONSTORING SERVICES OF AMERICA, INC Page: 2 Bellows: When Mr. Rogers actually started smoking and was addicted to it was long before the 1964 Surgeon General's warning on it. - Browder: Additionally, Bellows feels the tobacco attorneys were inconsistent for arguing Rogers knew smoking was dangerous and then putting on witness that testified that there was no medical evidence proves smoking causes cancer. Bellows: They engineer a cigarette to hook a person, to keep them hooked, to keep them buying cigarettes; that is their business. Browder: Rogers' widow and her attorney are disappointed by the verdict but still think the tobacco companies can be beaten, if others like Jim Bellows make up the juries, they may be right.- Cullen Browder, 6 News. Bremen: The jury in that case has talked about a holding a reunion, but Bellows says he is so upset at the verdict, he wants to wait and cool off before he sees the rest of the panel.
