Cheryl Adams, co-anchor: Big tobacco claims victory, but is the cigarette pack half full or empty. The tobacco industry is celebrating a split decision this weekend. A big win in court but a potentially bigger loss in the world of sports. In tonight's top story Fox News at 10, Russ McQuaid, tells us the legal sunshine may be overshadowed by storm clouds from the White House. Russ McQuaid reporting: An Indianapolis jury ruled that Richard Rogers had only himself to blame for his inability to kick a life long smoking addiction and rejected his widow's claims that four American tobacco companyies, through negligence and faulty products, caused Roger's death from lung cancer. David Anderson (Jury Foreman): However, we felt that the evidence did show a degree of negligence on the part of the cigarette company. Hardy: I'm not at all discouraged by the fact the jury said they found some fault on our part; we'll take a victory. Thank you. McQuaid: That court victory was a high point on an otherwise tough day for tobacco, as President Clinton announced new rules that would ban, among other things, advertising of cigarettes on billboards near the nation's schools, and tobacco advertising in magazines, like Sports Ilustrated. -Sports like auto racing would also be a hard hit because from Indianapolis to Booda Fest (sp) you can not turn a hot lap or go deep without cigarette money lurking somewhere in the background.
