James Adams, co-anchor: 0 Marion County jurors find in favor of four tobacco companies in a case monitored nationally by smokers and stock brokers. It took close to eighteen hours of deliberations, but tonight a Marion County jury decided a lifetime smoker is responsible for his own death, not the tobacco industry. Barbara Lewis, co-anchor: The widow of Indianapolis attorney, Richard Rogers, sued Philip Morris, American Tobacco, Liggett Group, and RJ Reynolds, claiming the tobacco should pay for the man's death. Adams: Cullen Browder joins us now; he has the latest on this very important case. Cullen. 0 Cullen Browder reporting: Absolutely, Barbara and James. It had national significance, especially coming on the heels of a verdict this month in Florida where a jury ruled against the tobacco companies, and it rewarded seven hundred and fifty thousand dollars to the smoker's family. Now, following that unprecedented verdict, tobacco company stock plummeted, and the nation looked at this case to see if the giant industry was in fact vulnerable. But the five-woman one-man jury felt that Richard Rogers was responsible for his deadly choice-to smoke. I don't believe that it is the end of the war against the tobacco industry. I believe that in my husband's death that even though we lost this trial that he has still made a difference. - Browder: The difference for the tobacco companies is they feel their stocks will rise again. David Hardy (Philip Morris Attorney): I'm not at all discouraged by the fact the jury said they found some fault on our part; we will take a victory. Thank you. Browder: Realizing the significance of their decision, jurors wanted to explain why. They said their verdict does not totally vindicate the tobacco industry in the face of a deadly addiction. Anderson: The negligence is that without a doubt there are dangers associated with smoking cigarettes. To be real honest, I think, if we would have seen examples that could 0 have tried come brought the evidence that Mr. Rogers had actually as hard as he said to quit, we perhaps would have forth with a different verdict. L) O V Browder: But the deciding factor for the jury, one welcomed by the tobacco industry, is personal V A O c0 responsibility. Hardy: It's meaning. It is 'do you have personal O V O responsibility, can you quit,' and many people that say cigarette smoking is addictive also say, `but you can quit.' Anderson: The only message I think I could give is, if you think it is going to cause health problems for you, I think there is evidence there, and you would be better off to quit. I know; I say that to my fiancee who smokes. Browder: A jury foreman, David Anderson says jurors struggled with their feelings on smoking from both sides; some fsel strongly that people make their own decisions to smoke, while others think that tobacco companies should actually be restricted from selling a product that can kill. But they said the weight of the evidence fell on the side again of personal responsibility. Now, Yvonne Rogers's attorneys say they are not sure if they will pursue-this lawsuit any further. 0 # # #
