Cigarette mak• ers long had boasted they had never paid a cent in health-relat- ed suits brought by smokers, A Florida jury earlier this month awarded 5750,000 to a man who got lung cancer after d4 years of smoking. It was only the second time a jury has ruled against the industry. The first verdict was overturned on ap- peal. Tobacco stocks plunged after the verdict and have failed to recover, as they have after past legal setbacks. The tobacco companies had not waited for Clinton's decision declaring tobacco an addictive dtvg 'fhe industry launched its challenge Aug. 18, the day the U.S. Food and Drug Administra- tton regulations were proposed. Within hours, lawyers for Philip Morris and R.J. Re nolds-an- nounced they Krou flle suit in federal court - in North Caroli- na, the heart of tobacco country. Since then, other cigarette makers have joined the case, and separate challenges were brought in the same court by the smokeless tobacco industry, ad- vertisers and convenience stores. After 16 hours of'delibera- tion, the state court jury reject- ed claims from the widow of Richard Roeersthatthecompa- nies were to blame for his life- time of smoking, which began at age 5 and ended with his death in 1987 at 52. '1'he suit, which had sought at least 5424,000, claimed Rog- ers. an attorney, was addicted to cigarettes and that smoking caused his lung cancer. Tobac- co lawyers said Rogers chose to smoke, despite warnings of the potential risks.
