Bucking the recent trend, Montgomery announced she will not take legal action to recoup money the state has spent to care for people with illnesses alleged to be smoking related. "Without a single court decision indicating these lawsuits can be won," Ms. Montgomery said, "I will not now ask Ohioans to risk the millions of tax dollars required and divert attention from the priorities of this office to take on the tobacco industry." While acknowledging that suing tobacco companies is politically popular, Ms. Montgomery said she opposed following other states that have hired private attorneys to litigate their cases. # $ #
