I. State Overview: Utah
Politics
The legislature meets annually and will convene the 1997 session on January
20th. The session will last 45 days, There are 29 Senators that serve for 4
year terms; the 75 House members serve 2 year terms.
The House and Senate are expected to remain republican.
This is not a favorable state for many of our issues. This is a strong religious and
local government control state.
The AG has indicated she plans to file a Medicaid liability lawsuit.
State Objectives
Introduce AAA/Youth Access bill
Defeat possible smoking bans in legislature and local communities
Defeat Excise taxes.
Defeat Marketing restrictions at the state and local level.
Assist with FDA and defeat similar measures at the state level.
Defeat legislation that bans smoking in condos.
Defeat divestment proposals.
II. Strategies/Tactics
Continue to build third party coalitions to support PM objectives.
Will need PR assistance if AG files.
Develop media materials for third-party al!ies.
III. Recommended Activities/Tools
Need continuous development of coalition for AAA, local activities and other
issues as they develop.
Need updated arguments and state specific materials re federal legislation, and
local issues.
Possibly, 2 statewide general and an undetermined number of local mobilizations
on smoking/marketing restrictions.
Continue to work with sales force and their accounts on PM
objectives.

Establish mechanism to direct mail to coalition partner's membership on FDA,
lawsuit and other issues where necessary.

STATE PLAN: 1997
WASHINGTON STATE
1. STATE OVERVIEW
A. Politics
The legislature meets annually, and will convene the'97 session on January 13.
The session is limited to 105 calendar days in odd years, and 60 days in even
years. There are 98 House members, serving 2 year terms, and 49 Senate
members serving 4 year terms. The House is controlled by R's, and although
they will likely lose several seats to the D's in November, they will retain
control and will have the same speaker. There will be a new majority leader and
caucus chair. The Senate is currently Dem by one seat. The R's will likely take
over in November, but it will remain close. New leadership would ensue. There
will be a new Governor in 1997. The current race is between D candidate Gary
Locke, vs R candidate Ellen Craswell. Conventional wisdom has Locke winning, as
Craswell is a Christian Coalition candidate. AG is up for re-election, but will
easily win. There will be a new Lt. Governor, likely Brad Owen, a former state
senator, and D who is a retailer. Secretary of State will be re-elected. Term
limits first impact will be seen in 1998 in the House and 1/2 of the Senate. This
may impact the House politics as members vie for future leadership positions.
II. State Objectives
A. Defend against smoking bans legislation in Restaurants & Bars: Gov will
drop bill through Dept of L&I to give the state authority. Threat: moderate
B. Assist Federal office on Federal Initiative
C. AG Suit has been filed/Assist in PR program
D. Defeat any AG/other bills to change liability law.
E. Pass bill strengthening youth access law (minor possession, change
funding to Liquor Control Board from Local Health Depts., affirmative
defense.)
F. Excise Taxes - Rollback? Depends on make-up of Senate and Gov's office:
will be very tough.
Ill. Strategies & Tactics
A. Ongoing education of on PM issues
B. Utilize think tank research to assess impact of dedicated funding for taxes, and
educate interested parties.
C. Continue coalition building with allied groups interested in opposing
dedicated funding.
D. Challenge anti's (including Dept of Health) use of ASSIST funds
E. Continue to monitor and effect local efforts to regulate on smoking issues.
F. Work with state agencies on impact of smuggling on state revenues.
G. Continue efforts with retailers to help with tax rollback.
H. Defeat divestment/ingredients legislation.

A. Continue participation with WA Assn. Neighborhood Stores on shared tax
rollback issue. Provide in-kind support through Subert-Gregory for
collateral and media support.
B. Continue participation in NW Business & Labor Alliance on smoking issues
both local and statewide. New leadership under Gregory/Dow.
C. Assist Federal office on FDA opposition with aid of Madison Group.
D. Sales Force participation in tax/youth access issues.
E. Media support from MAN network.
F. Mobilizations: 4 House committee, 2 floor; 3 Senate committees, 2 Floor.
G. Expert testimony on smoking issue.
I. Legal support for any Medicaid liability legislation.
J. Continued participation with 3rd party allies such Liability Reform Coalition
and AWB.
