STATE PLAN: 1997
ALASKA
I. STATE OVERVIEW
The legislature meets every year and will convene the 1997 session on January
13. The session is limited to 121 days, unless extended for a 2/3rds vote of each
house. The 40 House members serve 2 year terms, and the 20 Senate members
serve 4 year terms. House may change from R to D; Senate likely to remain R.
May have 5-8 new House members, and 4-6 in the Senate. There will be no new
statewide office holders. A new Speaker is possible in the House.
II. STATE OBJECTIVES
A. Pass AAA/Youth Access: Line of sight and/or unannounced inspections
standards
B. Assist Federal office on Federal Initiative
C. Continue to monitor Medicaid Liability/AG issue
D. Defeat excise Taxes: Gov likely to push for 51.00/pack in '97 (although the
recent increase in oil prices may alleviate the need for any new taxes in 97.)
III. STRATEGIES & TACTICS
A. Grassroots mobs to support anti-tax sentiment over the interim; enlist
wholesalers, retailers , anti-tax groups and consumers to educate legislators
regarding the tax issue.
B. Implement WE CARD program in AK. Send letter to all legislators regarding
the WE CARD program and industry support for the program. Press
conference with retailers announcing the successful implementation of WE
CARD.
IV. RESOURCES
A. Sponsor WE CARD seminars for trade associations
B. Support existing anti-tax groups
D. Targeted committee mobilizations: 4 (2/tax, 2/AAA); 2 Statewide
mobilizations: 1 consumer; 1 retailer

Accommodation
TAP to aggressively market program in Little Rock, Hot
Springs, Fort Smith and Texarkana (advertising, exhibits
and recruitment).

allies/spokespeople (AAA, FDA, Accommodation etc....)

I. State Overview:
Politics
The legislature meets during the odd years and will convene the 1997 session on
January 13th and will run through mid to early April. There is no limit on the
number of days they can meet. The 100 House members serve two-year terms
and the 35 Senators serve four year terms. Term limits will take affect in the
year 2000. The interim study period is anytime the legislature is not in session.
Democrats currently control the House 88-12, and the Senate, 29-6.
The political environment is complicated by Whitewater but remains somewhat
favorable to our issues. Newly appointed Governor Huckabee (R) appears to be
favorable an all issues with the exception of smoking in public places. Likewise
House and Senate leadership are supportive. In 1995 there was an attempt to
pass a 2 1/2 cent excise tax on tobacco products for breast cancer early
detection screening. This issue has stayed alive in'96 and we expect to see a
similar effort during the '97 session. Medicaid reimbursement will continue to
be an issue with President Clinton's home state influence.
State Objectives
1. Pass AAA type bill to reduce youth access to include proof of age, retailer
defenses, line of sight, reporting requirements and sales/marketing
preemption.
2. Seek opportunity to reintroduce and pass employment discrimination
legislation.
3. Pass positive tort reform in the areas of product liability, punitive damages
and attorney fees.
4. Look for opportunity to move medical liability and defense bill (i.e. North
Carolina language), Medicaid offset language and prohibition of contingency
fee arrangements.
5. Support Washington Relations office at Federal level (i.e. FDA initiative,
OSHA etc...).
6. Defeat any excise tax on tobacco products.
7. Prevent Medicaid Liability suit.
8. Continue to broaden and grow coalition base.
9. Expand public relation efforts throughout Arkansas.
II. Strategies

Draft California Plan
I. State Overview
Politics
Governor Wilson begins his final term in 1997. Republican Attorney General
Lungren will run against Democrat Lt. Governor Grey Davis, State Controller
Kathleen Connell or Senator Diane Feinstein to replace Wilson. Deputy AG David
Sterling will run for AG, against Senator Calderon.
The Assembly is split almost evenly: 41 Republicans, 37 Democrats, 1 Reform
and 1 vacancy. Republican control is in jeopardy in November.
Democrats will retain control of the Senate.
State Objectives
Modification of AB13, statewide smoking ban.
Respond to potential CaIOSHA petition on AB13.
Delay CaIEPA ETS risk assessment.
Defend industry immunity statute.
Defend against the filing of local liability lawsuits
Defeat local use restrictions
Defeat local marketing restrictions,

Mobilization of hospitality allies in support of AB13 modifications.
Activate manufacturers' trade groups in opposition to liability.
Enhancement of local action network.

and other issues where necessary.

Possibly, 2 statewide general and an undetermined number of local mobilizations

partners on FDA, OSHA and other issues when appropriate.

I. State Overview: Arizona
Politics
The legislature meets annually and will convene the 1997 session on January
13th. There is no limit on the number of days they can meet. however, it has
been legislative practice to try to limit the session to 100 days. There are 30
Senators that serve for 4 year terms; the 60 House members serve 2 year
terms.
Both houses are expected to remain republican controlled, although both houses
will elect new leadership in the majority parties. Both the Speaker and the
President of the Senate did not run for reelection.
In the recent past, the Speaker of the House was not favorable to the industry and
no bill supported by the industry was allowed on the floor under his leadership.
The Attorney General has filed a lawsuit against the industry.

I. State Overview: Colorado
Politics
The legislature meets annually and will convene the 1997 session on January
8th. There is a constitutional requirement that sessions do not extend beyond
120 days. There are 35 Senators that serve for 4 year terms; the 65 House
members serve 2 year terms. This will be the last term for many because term
limits will require that several to not seek reelection.
Both houses are expected to remain republican controlled. However, the Senate
has a very narrow margin. If the republicans retain control of the Senate,
leadership is not expected to change.
This is not a favorable state for many of our issues. This is a strong local
government control state.
State Objectives
Introduce AAA/Youth Access bill
Defeat possible smoking bans and marketing restrictions in
legislature and local communities.
Defeat billboard bans.
Assist Washington office on federal issues (FDA, OSHA).
Assist MU at state and local level.
II. Strategies/Tactics
Partner with existing retail coalitions to work on FDA, AAA and OSHA.
Continue to use local PR firm to assist in legislative and other
governmental affairs objectives.

Need continuous development of coalitions for AAA. FDA local activities and other
issues as they develop.
Need updated arguments and state specific materials re FDA & federal tobacco
youth access initiative, local issues.

Continue to work with sales force to enhance communications with their accounts
on state and local issues.

Draft Arkansas State Plan
Add to lobbyist base to cover the diverse changing environment
of the Arkansas legislature as term limits approach.
Use political consultants to develop grass roots opportunities for
gaining support of newly elected legislators.
Use public relation consultants and media affairs to support
attainment of objectives by developing the right public
atmosphere.
Promote alternative solutions backed by Governor to fund breast
cancer early detection.
Utilize traditional and new third party allies to support legislation intended
to reduce youth access legislation.
Continue to support and work with Arkansas Tort Reform
Association Coalition to seek positive Tort Reform legislation.
Identify third party allies supporting employment
discrimination legislation in 1992. Enlist support and
develop new third party allies to support passage of employment
discrimination legislation and work with Walmart to obtain
agreeable language.
Enlist the assistance of wholesalers, retailers, and anti-tax
groups to educate legislators and executive branch regarding the
potential economic downside new excise taxes will have on the
economy.
