Dear Valued Retailer:
Philip Morris USA has been notified by state authorities responsible for enforcement that
the following store has been fined for or convicted of selling cigarettes to minors:

Last year, Philip Morris USA announced its Action Against Access initiative which builds
on our long-standing opposition to youth smoking. In conjunction with Action Against
Access, Philip Morris USA announced a 1996 Responsible Retailer Program. In order to
participate, a retailer cannot be fined for or convicted of selling cigarettes to minors. Based
on the information above, you are no longer eligible to participate in this program.
In addition, in an effort to encourage continuing compliance- with minimurrr age laws,
P hilip Morris further announced it will withhold merchandising benefits from stores which
have been fined for or convicted of selling cigarettes to minors.
Philip Morris's objective in announcing Action Against Access has been to make it as
difficuit as possible for minors to purchase cigarettes at retail. If you join us in this
commitment by having your store satisfy the elements of the We Card Program developed
by the Coalition for Responsible Tobacco Retailing, we will waive this initial suspension of
merchandising benefits from your store. We Card materials are free of charge and may be
ordered by calling 1-800-934-3968. Failure to participate in the program will, however,
automatically result in a one-month suspension of Philip Morris USA merchandising
benefits.
If Philip Morris USA is subsequently notified by enforcement authorities of additional fines
or convictions of the store identified above, a one-month suspension of merchandising
benefits will be imposed for each such additional fine or conviction. If a store is fined or
convicted three times within twelve months of a fine or conviction for which
merchandising benefits were suspended, Philip Morris USA will suspend the store's
merchandising benefits for four months.
Upon notification of a subsequent fine or conviction for the sale of cigarettes to minors, no
waiver will apply and a one-month suspension of merchandising benefits will be imposed
for each fine or conviction. If the store is fined or convicted three times within a twelve
month period commencing after a four month suspension of benefits, Philip Morris- USA
will again suspend the store's merchandising benefits for four months.
Our representatives will be calling on your store to discuss this matter further and verify
your progress toward the goals of Action Against Access.
