(212) 878-2812 CHRONOLOGY OF ACTIONS 1989 Nov. 15 Philip Morris U.S.A. identifies Marlboro trademark infringement on "Super Monaco GP" video arcade game manufactured by Sega Enterprises, San Jose, Calif. Nov. 20 Philip Morris U.S.A. sends a letter to Sega Enterprises demanding that the company cease all use of the Marlboro trademark on its "Super Monaco GP" video arcade game and recall all games where the Marlboro trademark appears. 1990 March 20 After lengthy negotiations Sega Enterprises formally agrees to have Marlboro trademarks removed from its games. July 23 Philip Morris U.S.A. identifies "Super Monaco GP" games in Chicago, Ill. and New York City in violation of the March 20 agreement and notifies Sega Enterprises to correct these violations. Sept. 18 Philip Morris requests confirmation that the violations in Chicago and New York City were corrected. 1991 Feb. 12 Philip Morris U.S.A. becomes aware of additional trademark infringement on "Super Monaco GP" game. Feb. 21 To date, Philip Morris U.S.A. has not received confirmation that the violations in Chicago and New York City were corrected. Philip Morris files a trademark infringement lawsuit seeking monetary damages and remedial actions against Sega Enterprises for breach of its March 20, 1990, agreement.
