Potential Implications of Risk Assessment
Anticipated risk reduction for nonsmokers.
Report widely reported as the most significant event in tobacco
control since the 1964 Surgeon Generals report on the health risks
of direct smoking.
Designation of ETS as known human carcinogen dramatically .
increases potential liability of building owners/employers that
continue to permit smoking indoors where nonsmokers can be
exposed.
Prisoners have sued (and lost) on grounds of cruel and unusual
punishment; case currently pending Supreme Court review.
Findings on respiratory effects in children alrepdy being used in
custody proceedings; could stimulate litigation based on asthma or
0ther acute effects in restaurants and other places where children

Extent of potential liability will be determined in future court cases
Bills being introduced at state and local level to restrict smoking
Senator Lautenberg and Congressman Durbin have introduced bills
