T a IN THE UNITED STATES DISTRICT COURT FOR THE MIDDLE DISTRICT OF NORTH CAROLINA WINSTON-SALEM DIVISION FLUE-CURED TOBACCO COOPERATIVE STABILIZATION CORPORATION, et al., Plaintiffs, v. UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, et al., Defendants. ) ) ) ) ) ) ) Civil Action No. 6:93CV370 ) ) ) ) ) ) PLAINTIFFS' MOTION TO EXTEND PAGE LIMITS On September 30, 1994, defendants submitted several different motions supported by two lengthy briefs -- one of which covers 40 pages. In response to these potentially dispositive motions, plaintiffs submit the attached 32-page memorandum. According to Local Rule 206(c), this brief may be viewed as exceeding the suggested page limitations for brief in opposition to motions for summary judgment. Therefore, plaintiffs request leave to file a brief in excess of the prescribed limit. The government's brief raises many issues dealing with the need for discovery in this case and the inadequacy of the "administrative record" produced by EPA that cannot be adequately addressed within the page limits suggested by Rule 206(c). .i~ Moreover, in seeking leave to file its lengthy brief, the o ~ government stated that it would not object if plaintiffs wished rn ~ to file a responsive brief of comparable length. ~ 00 O 1-~ Q~
