That consideriug what is stipulated in the -Additional
Provision -7r.. 2 of the &L'atutory Instrursent 192/1998, of 4th
March, per-_aining to the limitations on the sale and use of
tobacco, for the protection of public health, under which the
proprietor of an estabj.ishment, which is open to the public, wi? 1
be able to i=ose a ban on smokir.g in t_%at esta.blishmen.t,
provided cY_at the users are properly advised thereof in advance_
Z'hat considering the desirability to set up mechanisms to
sensitize and uhdnge the attitude of the businesses so as to
procure, a:c far as possible and without hann.ing the legitimate
economic and commeTcial interests of the activity, that they
create in their establishment sections reserved to customers who
a.ze non-tobacco-users.
That considering also the expediency to encourage tolerance
and courtesy beLween smoking and non-smok{ng customers, on the
s basis of mi:tunl respect.
That 3s a r.Psult of what is set out above, and on the
strength of' the powers granted, they agree to sign this GSMRAL
AGRSSQNT OF COLhAHORATION, in accordance wit2l the following

FIRST:
As of I October 1994, the HeaLth Council of the City of
Madrid, vs:a the Direccion General de Pravencibn y P=oraoaion de
la Salud (General Management of Prevention and Hea? th Promotion)
and the Madrilenian Association of Restaurant and Cafeteria
Managers, uill jointly launchh a popularization campaign, by means
of broehurEs, circular letters etc. among restaurants of over 25
tables, co=nicating to them the desirability to reserve a
section of the HFca.blishment to non-smokers.

The r1.on smoking section will be duly marked and it is
reconaaeudece that J.L cover a surface area of at least 25: of the
total capacity of tables of the room or rooms.

inr the establishments indicated in this QSNSRAL AGR$EN=
OF COLLASOFtATION and in which it is materially impossible to
reserve sections to non-smokers, the necessary steps will have
to be tak::u to instal l air-extraction and aircora.ditioning
systems.
FODRTEs
This GENSR,AL AGR&EMMTT OF COLLADORATION uri11 not affect the
estabZisbatents or part of them when they are totally or partially
hired and w-hen the pubZic has no access to the h.ired section.
FIFTS:
In order to check the degree of voluntary fulfilment of this
GENERAL At3FSMUNT OF COLLABORATION, a MONITORaTG COMbfZ85I0N is
created, which will have equal rep=esentation and which will
coasist of TWO cuetabers of each of the parties and which will
convene on a six-monthly basis, and whose duties will be:
a) 2o work out the Census of Restaurants of over 25
tables.
b) To inforn both parties in writi.^1g of the degree of
establisament of the non-smoking sections, on a six-
monthLy basis.
To resolve any doubts that might ar?se relating to the
application of this GENTR.AL AGAEEMM OF
COLLABORATION.
