Dear Jeff;
Attached is a copy of the draft letter that we have
discussed focusing on the role played by Jim Repace in the
preparation of the EPA documents on environmental tobacco
smoke. -
During the past week, we have had substantial, and I
think productive, discussions within the industry concerning
the advisability of our sending the attached letter to Bill
Rgilly. The letter clearly would move the dialogue you have
been having with agency officials to a new level, I am not
sure whether up or down. The consensus view that we have come
to, and that we offer for your consideration, is that you
might most appropriately use the substance of the attached
letter to have a conversation with EPA's congressional liaison.
You could point out at that time, of course, that you are
prepared to proceed by sending a formal letter if officials at
EPA are not sufficiently receptive to the concerns you are
raising,
by dispatching of the letter -- may well be the most prudent
an informall conversation first to be followed, if necessary,
The most substantial concern that has been raised .
about the attached letter in its current.form is that,.because
it focuses_on a"sxngle individual within EPA, it might cause
other agency officials to close r~nks to "protect one of.their
own." Reasonable people undoubtedly could differ in that
assessment, and certainly have in the discussions to which I
have beeri-a party, but taking the matter in two steps -- with
way to proceed.
