Box 301014 Lansing, Michigan 48909 Dear Representative Dunaskiss:: Hopefully, this letter will answer a q,uestion that you raised at the Public Health subcommittee meeting, that was held in Westland, on September 9, 1985. Your question1was: "Whether it was legal to base a hiring decision on whether or not a person smoked?"' The answer is yes. Neither Michigan law, nor Federal law prohibits this Dractice. Specifically, Michigan law under MCLA 37. 2202' states :• Sec '202. (1) An employer shall not: (a) Fail or refuse to hire, or recruit, or discharge, or otherwise discriminate.against an individual with, respect to employment, compensation, or a term, cond'i- tion, or privilege of employment, because of reli ion, rare color, nnational origin age, sex, hei ht, weig.ht,, or marital status. (emphasis a e)- Furthermore, Federal law does not prohibit basing a hiring, decision on smoking either: (a) Employers. It shall be an unlawful employment practice for an employer-- (1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual's race, color, religion,, sex, or national origin;, ('emphasis added) 42 USCS § 200'Oe-2 0 C DD-1
