Update April 19, 1993 Electromagnetic fields (EMF) • The Environmental Protection Agency (EPA) will hold a scientific conference to assess the current knowledge about the biological and health effects of radiofrequency (RF) radiation. Experts have been invited to present papers and participate on panels to address RF radiation. The Conference will be held Apri126-27, 1993 at the Holiday Inn, Bethesda, Maryland. • Conversations with the staff of the Subcommittee on Energy and Power indicate that no precise dates have been set on further EMF hearings beyond the hearing held on April 1, 1993, although more hearings are definitely a possibility. We continue to monitor developments. Radon • The General Accounting Office (GAO) released a report entitled, "Air Pollution: Actions to Promote Radon Testing". At the request of Congressman George Brown, Jr., and Congressman Robert Walker, of the Committee on Science, Space, and Technology, the GAO investigated and reviewed programs and activities that promote radon testing. The Report discusses information on EPA's public information leducation programs to promote radon testing; State programs supported by federal grants; voluntary radon testing during real estate transactions; and radon testing requirements for real estate transfers financed through federally related housing programs and in federally subsidized housing. (Copy enclosed). • EPA's proposed Model Construction Standards and Techniques for Control of Radon in New Buildings was published on April 12, 1993 for review and comment. These model standards and techniques are designed to prevent or reduce the potential for elevated levels of indoor radon in newly constructed buildings and are provided for use by national code development organizations, states, and local jurisdictions as they develop and enforce building codes. The publication of model standards and techniques are required under Section 304 of Title III of the Toxic Substances Control Act. Written comments need to be submitted by June 11, 1993. (Copy enclosed). Risk Assessment Items • There are several risk assessment conferences of note taking place next week and in June. The meeting schedules are included in the Upcoming Conferences section. • EPA staff are watching developments of a bill introduced in January by Senator Moynihan (D-NY) entitled, the Environmental Risk Reduction Act, which would increase EPA's activities in numerous areas, particularly in the risk assessment area. 1

• The Executive Committee of EPA's Science Advisory Board, will hold their quarterly meeting on Thursday and Friday, Apri122-23, 1993 at the EPA Headquarters in Washington, DC. ETS • On April 5 we reported that the Congressional hearing on environmental tobacco smoke was postponed from April 1, 1993 to May 12, 1993. The hearing was called by the Subcommittee on Specialty Crops and Natural Resources, House Committee on Agriculture, was scheduled to investigate procedural and scientific issues relating to the ETS report released by the EPA on January 7, 1993. Inquiries and conversations with staff from the House Subcommittee on Specialty Crops and Natural Resources indicate that as of April 19, 1993, the hearing on environmental tobacco smoke has not been rescheduled to May 12, 1993, as previously announced. We continue to monitor developments. + In a letter dated February 8, 1993, Richard Hembra, Director, Environmental Protection Issues, GAO, sent Congressman John Dingell, Chairman of the Subcommittee on Oversight and Investigations, Committee on Energy and Commerce, a letter on ETS. The letter responds to the Chairman's request that the GAO review the public release by the EPA of three draft documents dealing with environmental tobacco smoke. (Copy enclosed). + According to discussions with the staff in the Indoor Air Division, the "Environmental Tobacco Smoke: A Guide to Workplace Smoking Policies" is in draft form and unavailable for public distribution. The release of this document to the public, in draft or final stages, will depend on the new EPA team and the new Assistant Administrator for Air and Radiation. • The brochure and a Physician's guide on indoor air quality related illnesses and causes, are part of a series of public information documents on indoor air quality being drafted by EPA staff. According to the Indoor Air staff, the brochure is in a very draft stage and discussions are currently taking place on the process EPA will undertake regarding the brochure's release. The working title of the brochure for now is "What You Can Do About Second-Hand Smoke", however our sources indicate that the title may change depending on the comments during the review process. The Physician's guide, while in a more complete stage, has been undergoing review in the Agency for a year and a half, according to the staff. The staff mentioned that the Tobacco Institute commented on a draft of the Physician's guide in late 1991 or early 1992. The "working title" of the guide according to EPA staff is " Indoor Air Pollution: An Introduction For Health Professionals" although they emphasize that this title could change. 2

Indoor Air Office • On March 25, Senator George Mitchell introduced S. 656, the "Indoor Air Quality Act of 1993". The bill, will "provide for indoor air pollution abatement, including indoor radon abatement, and for other purposes". The bill has been referred to the Committee on Environment and Public Works. No further action has been taken on the bill as of Apri120, 1993. 0 Congressman Joseph Kennedy (D-MA) plans to re-introduce a more streamlined indoor air bill. • While EPA has not announced candidates for the position of Assistant Administrator for Air and Radiation, we have learned from various EPA sources that the names being considered for this particular position have been closely guarded because of the many Clean Air Act related issues awaiting administrative action. The names floating around this week are: Mary Nichols, an attorney with the Natural Resources Defense Fund and Gail Bingham, of the National Wildlife Federation and Resolve, Inc. Ms. Nichols is the former chief of the California Air Resources Board and Ms. Bingham is currently serving as the team leader for the Disinfection by-products regulation negotiation process. Items of Interest • A meeting of the Technical Advisory Group for Cigarette Fire Safety will be held April 29-30, 1993 in Gaithersburg Maryland. Under the Fire Safe Cigarette Act of 1990, the Consumer Product Safety Commission (CPSC) and the National Institute of Standards and Technology (NIST) is directed to conduct research concerning the feasibility of a performance standard to address the propensity of cigarettes to act as an ignition source. • In EPA's 1994 budget, released on Thursday April 8, 1993, on page 14 of the summary under the section entitled, "Continuing the Development of Cooperative Indoor Air Programs", there was a note reporting that the 1994 indoor air budget of $6.9 million will be used in part to establish an outreach program to inform the public of how best to mitigate secondary tobacco smoke. The article is enclosed. • EPA elevation to Cabinet status S. 171, is being reviewed by the Senate Government Affairs Committee. A markup of the bill took place March 24, 1993. The Senate Environment and Public Works Committee had a hearing on the bill on April 1, 1993 was placed on the Senate Calendar on April 15, 1993 on general orders. It is awaiting action on the Senate floor but as of April 19, 1993, it had not been brought up on the Senate floor. 3 I
