Dear Mr. Myers:
Reference is made to your letter dated June 11, 1981 in
which you requested comments on the proposal that the FTC modify
its cigarette testing methodology by substituting the Cambridge
Filter Holder Mark II ("Filtrona Holder") for the holder currently
in use.
At the outset it should be noted that underlying the pro-
posed change is the fallacious assumption that a laboratory testing
method could equate to human smoking. it is patently clear that no
laboratory testing method ever has or could produce a quantitative
result which any smoker could or should take to be equal to a quan-
tity of an ingredient which that smoker will ingest while smoking a
cigarette. No two smokers smoke in precisely the same manner and
no smoker smokes any two cigarettes in precisely the same manner.
Consequently, any complaint that a laboratory testing methodology
is faulty because it does not seem to equate to what smokers per-
ceive when they smoke a cigarette is without merit.
The two essential ingredients.of an FTC test methodology~
must be the ability to accurately and precisely determine compara-
:e tive levels of ingredients and to provide absolute continuity of
results from test to test in order to avoid consumer confusion. N
American Brands, Inc. has been unable to verify or replicate the o
data submitted with your letter of June 11, 1981 because, in spite ~
of strenuous efforts, it has been unable to obtain supplies of the ~

"Filtrona Holder" from the American Filtrona Corporation or else-
where. I am informed that supplies, which have been on order from
England, will not be available until the latter part of this month
and that the required testing procedures will take an additional 4
to 6 weeks. Consequently, I strongly urge that the period for re-
ceiving comments on the proposed modification of the Commission's
testing methodology be extended until mid-September.
If the Commission is to modify its test methodology, it
is urged that no change be made to a method which has not been sub-
jected to a thorough and extended collaborative and corroborative
testing procedure which will stand the most critical scientific
scrutiny.
