Miami News NEW ORLEANS - A Federal Appeals Court has dpheld a Miami Federal Court ruling exonerating a bobacco firm in the death of a Coconut Grove man from bmg cancer caused by cigaret smoking. The jury had decided that while cigaret smok- ing helped cause the death of' 49-year-old ~uilding elntractor Edwin Green in February 1958, the tobacc,o firm - American Tobacco Co. - could not have forseen that Lucky Strike smokers would be es,daagered by smoke inhalation. In New York, American Tobacco President Paul Eahn said the company was gratified by the decision 6f the 5th U. S. Circuit Couec of Appeals. Green had filed the suit in 195 7, several months 'before he died. His son, F.dwin Green Jr., was sub- stituted as a plaintiff under Florida law. The elder 6ksen's widow, Mary, of 2712 SW 1?th Ave., also Iteiped carry on the 1Y2-atillion-doliar suit. Green's deposition said he had smoked at ieastt three packs of Luck:es a day fn_ 25 years and stopped ih late 1956 when he started coughing blood. Circuit Court of Appeals yesterday upheld the verdict of a Florida jury which found that a man died of lung cancer caused by cigarette smoking but exoner- ate& the cigarette manufacturer. Edwin Green Sr. brnught the suit against the American To- bacca Co. in December, 1957, claiming he.had developed lung cancer as a result of smoking Lucky Strike cigarettes: Green died a few months later. Under Florida law, his son, Ed- war& Green Jr., was substituted as plaintiff. Green's widow also filed suit .
