Would prohibit smoking in day care and health care"
facilities; would prohibit the free distribution of
sample cigarettes; would restrict the sale and
advertising of tobacco products.
On Friday, 4/10/87, at 5:45 p.m., after testimony by
Attorney Rupp, Vernon Dempsey and Attorney James
Erickson, Senate Health Crate. deleted all references
to sampling restrictions and advertising restrictions
relating to billboards, newspapers and magazines.
House Health Cmte. has companion and will hear bill
within 10 days. House bill contains ad and sampling
restrictions contained in original Senate bill.
Measure stayed on General File after 4/10/87 Crate.
action. On 5/14/87, Senate passed HOUSE VERSION, HF
1283 which was the vehicle for the legislation. See

Bans smoking in most public places and requires
restaurants to provide 25 percent of seating capacity
or floor space, whichever is greater, for non-smokers.
It also requires that customers be told whether
non-smoking areas are available and be asked which
type of seating they prefer. Restaurants can appeal
to the council to reduce the 25 percent requirement
under a "hardship" provision. Bars, lounges, private
clubs and recreation facilities are among areas that
are excluded from the smoking ban. The ordinance
mainly affects the half-dozen exclusive resort hotels
and a few other restaurants in the affluent,
16-square-mile, largely residential community.

ordinance.

5/18 - BILL AMENDED WITH BODY OF HB 1430 (WHICH MAKES
IT COMMITTEE SUBSTITUTE AND COMPANION TO HB 1430), AND
PASSED OUT OF COMMERCE BY VOICE VOTE (8-0), NOW GOES
TO APPROPRIATIONS.
