STATE HEADLINES
Expect Minnesota governor to sign measure (H529) Increasingcl~larette tax 15 cents, to
38 cents, and l~lking the OTP tax from 25 to 35 percent. The-bill, wl~lcl't passed the
Senate 5/19 and the House ,5/18, Includes tax on floor stocks...effective date 6/1. New
rate would make Minnesota tax the nation's highest.
In Its rush to adjourn the Minnesota legislature also passed the nation's first ever
statewlde sampling ban (_.~. all tobacco products... "couporilng" 'not covered in
law...ettectlve date 8/1. The sampling ban emerged 5/18 from conference cmte, passlng
the House 5/18 and receiving Senate okay In the waning moments of the session on 5/.19.
Only exemption from the ban would be that "single serving samples of tobacco may be
distributed In tobacco stores." Governor expected to sign this measure and the tax
bill by 6/2 deadline.
On Its way to the governor: Oklahoma tax bill (H1061) to raise the rate from 18 to 23
cents...passed the House 5/2W'('53z'4~, Senate 5/21 (31-1;5}. ~l~is omnibus tax bill also
ncI'ff6~ases rates on gasoline, liquor, beer and the sales tax to meet $348 million budget
shortfall.
California bill (ACA14) to hike the state cigarette tax 25 cents (and "proportionate"
OTP tax} via a constitutional amendment died 5/18 tor lack of a motion in the Assembly
Tax Cmte...no vote was taken. At that point AZq08, a "trailer" bill to ACA14 was
withdrawn...the trailer would have created special fund for some tobacco tax revenues.
TAXES
Now formally Introduced In Wisconsin A390...measure would Increase tax from 25 to 28
cents and hike OTP from 20 to ;~0 peicent...bill awaits action In'Assembly Ways & Means.
Other tobacco products...Delaware Senate Revenue Cmte reported S130, to repeal OTP tax,
on 5/13...state voted earlier this year to cut rate in half, down to 15 percent.
Alaska House adopted new 25percent OTP tax 5/13... H260 was assigned to five Senate
crates, beginning with State Atlairs.
Newport News, VA, 5-cent hike proposal up 5/26 for city council deliberation.
SMOKING RESTRICTIONS
Nevada House concurred with Senate amendments to A155 on 5/15 and sent the restriction
~e to governor...as amended, bill adds 9rocery stores to restriction areas and
iequires state 9overnment department heads to set smoking policies.
Meanwhile in Arizona, Senate passed restriction proposal (H2069) on 5/16 and sent It
back to the H~concurrence~..state-ow .ned buildings would have to restrict
severely or prohibit smoldn~t In areas ot put~llc access and'bill mandates separ'~/~t~
sections In private workplace areas of such buildings.
Alabama restriction bill (H67) subject of 5/20 House Health Cmte hearing...no vote
taken and measure assigned to subcmte for further study...on 5/19 Senate companion
($420) Introduced and referred to Health Cmte.

New England...Vermont governor expected to sign bill (H86) requiring employers to
establish or negotiate workplace smoking restrlctlons-~..House and Senate approved the
measure 5/.14 after amending out tlae "one nonsmoker veto" provision in conference crate.
On 5/.18, Connecticut 9overnor sl~tned H5085, measure expanding the "1983 law by requiring
employers ot ,50 + to designate nonsmoklng areas...the law effectively preempts local
action. Maine bill (LD353), amending current state restriction law, approved |n House
~..S-~-fi'-~ floor action possible today...llkely amendment in Senate would exempt
county/local application.
Other state actlon...ln Florida, restriction bill (S414) to Senate Appropriations after
5/'18 approval by Sena~merce. Broad Missouri restriction bill (S"111) passed full
Senate 5/19...the measure lncludespreemptlon of local ordinances...last week tlae House

In New York...Nassau Coun~ officials discussed but took .no action 5/20 on. t.wo.draft
restriction proposals...one drhft would ban smoking entirely in re~aurants while the
other would allow 25-percent of seating for smokers...next hearing slated for 6/9...
Nassau already has In place ~'dngent workplace law. On 5/22, Monroe Count~ Human
Services Cmte may draft NY Public Health Council-style ordinance proposal...it proposal
ls drafted and adopted, full council action could occur 6/9.
California communities...Rancho Mirage holds final readlnll of modified smoking ban
ordinance ~...new version allow~ employee smotdng lounges and 1/3 smoking set-aside
in restaura~nti-tobacco coalition expected to push for total smokin~ ban in
restaurants, workplaces and other public places during b/1 nearing in Merced...Davis
okayed workplace/restaurant restrictions 5/13...Burlingame adopted on-W571-9 rem--~'~ion

Ohio locals...broad North Canton ordinance rejected S/.18, but on S/26 council to hear

areas...there is, however, no reterence to private workplaces. Hearing scheduled

New York Assemblyman Grannis bill (A5546) to limit cigarette vendinl!l sales to places
