FET/Airline Bans, State Efforts During the Recess

GENERAL
On 7/15, Mailgrams were sent to 1,684 TAN activists in
states represented by Stennis, Kasten, Byrd, D'Amato,
Chiles (transportation subcommittee targeted members).
First-class letters went out 7/20 to 2,222 TAN activists
served by other members of the Senate Appropriations
Committee. This mailing cdncerned airline smoking bans.
Another TAN mailing on the airline ban situation was sent to
nearly 13,000 TAN activists around the country (all but P.M.
activists). It went out week of 8/10. By 9/8, we had
verification of i,I08 letters from activists.
Week of 8/10, we completed a mailing to our state
legislative counsel and tobacco wholesaler executive
directors regarding both the airline and FET projects.
On 8/17 local PA counsel Ron White shared correspondence
from the National Black Conference of State Legislators
regarding the FET.'..NBCSL president has sent letters to
several lawmakers in opposition to such increases. NBCSL is
also encouraging its members to write lawmakers in
opposition and will do what it can re the airline ban...Bill
Cannell has been working closely with this group and will
encourage NBCSL to expand its congressional letter writing
campaign.
... On 9/1 White reported to Cannell that an anti-excise
message from the NBCSL would go out to members of the Ways
Means and Senate Finance Cmtes.

NTC head Bill Balden is generating correspondence from his
entire list of contacts on the airline situation. Balden is
also contacting his coalitions 'about the FET. We will
endeavor to seek the aid of other farm/tob-~-6coland groups.
Field staff members will continue to work on constituent
contact efforts, coordinate personal lawmaker visits and,
where possible, work with airport authorities against the
airline ban. This will be done in conjunction with
legislative counsel/allies; similar efforts underway on FET.
Anne Duffin is working with Women Involved in Farm Economics
(WIFE) to encourage additional letters against the airline
smoking ban...a mailing went out week of 8/10.
National Assn of Black & Minority Chambers of Commerce
president has written Rostenkowski and Bentsen in opposition
to cigarette FET...BIII Cannell encouraged this contact.
By 9/8, we had verification of 2,600 letters to congress on
the FET from TAN members and allies.
In general, wholesaler association contacts on FET and
airline issues have been excellent. Most sent
letter-writing calls to action to their memberships, and
many have organized legislative visits and other contacts.
SPECIFIC REGIONAL EFFORTS
Airlines ....
REGION I (Dyer/Jackson)
General
Dyer/Jackson have asked counsel in NH, CT and VT to contact
their senators. Wholesalers in each state have also been
requested to contact these senators. Region I is following
up on the TAN mailing via in-house phone bank operations.
Sen Leahy (D-VT)
Sen Weicker (R-CT)
... In early August correspondence to constituents, Weicker
says "for the present" his position is to balance the rights
of smokers and nonsmokers.
Sen Rudman (R-NH)
Sen Pell (D-RI)
... Counsel Governor Roberts says that while Pell remains a

strong anti-tobacco adyocate, Pell promised to examine the
issue closely and remained noncommittal.
Sen Chafee (R-RI)
... While he was noncommittal to Roberts, there is no reason
to believe he will not actlvely support the airline ban.
FET ....
General
Steps similar to those undertaken regarding the airline
situation have been initiated in the region.
Rep Kennelly (D-CT)
. Rep Donnelly (D-MA)
... 298 letters to Donnelly during the break and late
July...Dyer notes that these letters went out in July under
the direction of an active Lorillard representative.
Rep Gregg (R-NH)
Sen ~itchell (D-ME)
... Bellveau remains in touch.
. Sen Chafee (R-RI)
... Efforts here to be very limited...Roberts has touched
base.
REGION II (Scanlan/Kupris)
Airlines ....
Kupris has initiated an excellent, full-blown contact
program, including coordination of a letter campaign,
counsel/other personal visits with lawmakers, ally work
(including drafts of resolutions for groups to pass), and
work with airport executives, among other activities.
Sen D'Amato (R-NY)
... On 7/20, counsel Dan Adams spoke with staff aid who said
she would advise the senator to remove the airline issue
from the appropriations legislation.
...Counsel Mataraso -- D'Amato's Upstate campaign

coordinator -- spoke with D'Amato 8/7. D'Amato told
Mataraso that the "Durbin amendment won't get out of
.subcommittee because of Senator Hollings' opposition."
D'Amato, himself, remains noncommittal on the airline
smoking ban issue.
Sen Lautenberg (D-NJ)
... Counsel Joe Katz reports 8/20 that while Lautenberg does
not favor the Durbin approach, he does support a total
smoking ban on airlines, perhaps accomplished
administratively through the DoT.
... RJR's Ainsworth advised 8/5 he would ask their NJ
counsel Hodes to contact the senator. Hodes is a Democratic
activist who knows the senator well.
... On 8/21, Philip Morris representative reported that his
company's contacts with the NJ/NY Port Authority were
proceeding...the Authority is aware of the problem and
shares our view on the Durbin amendment...after the
Authority completes its in-house review process (probably by
the 8/26), it will likely gear up for legislative action.
... wholesaler D. Goldfarb was sent early information for
contact with the senator. Goldfarb is working with
senator's AA to set up personal meeting in August. Goldfarb
has pledged to generate at least 50 letters as well.
... Kupris advised of contact needs 8/5 and will pursue
letter writing activities, personal contacts, and through
Shea & Gould, contacts with NJ/NY Port Authority.
... Lautenberg remains noncommittal in his standard letter
to constituents...we have copies of the the same letter to
dozens of constituents.
Specter (R-PA)
... Kupris to generate constituent and other contact, while
counsel Cornell has been asked to meet personally with the
senator.
Kupris has asked tobacco wholesaler association executive
directors in PA (Enders wrote her members 8/12), NY
(Elicofon wrote his members 8/13) and NJ to push their
memberships re letter-writing contacts. Kupris also drew up
a draft resolution against airline smoking bans and asked
that the associations adopt the resolution and send it to
their congressmen...I've asked other field staff members to
consider a similar approach.

the Council of State Governments adopted a resolution in
opposition to federal increases.

... Constituent mail indicates the rep is opposed to excise
hikes.

... Mail to constituents indicates Moynihan favors an
increase in the cigarette FET.

... Mail to constituents indicates no firm opinion.
Airlines ....
REGION III (Trisler/Pruett)
walt Maner and the MI Assn have been most persistent w~th
their contacts with members on the airline ban.
The region has no senators on the Appropriations Cmte.

Rep Durbin (D-IL)
... Counsel/distributor Bud Kelley met personally week of
8/24 with Durbin. Although Durbin is his congressman and
good friend for over 20 years, no change in Durbin's
attitude from the meeting. Durbin did say that he was
doubtful about his amendment's chances in the Senate.
. Indiana distributor assn contacted its members asking for
assistance on both the FET and the airline issues.
MI wholesaler association asked its members to write
senators and congressmen re the ban on 8/27.

Counsel T. Kelm and D..Horasdovsky have met with the
Minneapolis/St. Paul airport manager to encourage his
opposition...Kelm has excellent contacts in that he
represents the airport commission. Since the Minneapolis
airport services most Wisconsin traffic, this contact will
help in our dealings with Senators Kasten/Proxmire...while
Minneapolis airport authorities share our view, this
Northwestern Airlines hub has been preoccupied with the
Detroit crash week of 8/17.
Counsel P. Sicula and Joe Czerwinski will meet with
Milwaukee General Mitchell Field contacts and with Kasten
and Proxmire. Brozek and contacts will work the Wausau
airport which services Rep. Obey (D-WI).
Counsel C. Wasker will meet with Des Moines airport
officials.
Sen Grassley (R-IA)
... Wasker set up private meeting with the senator for
8/10...Wasker says Grassley is "firmly on the fence."
Wasker pushed hard and will contact the senator again during
the recess.
Sen Kasten (R-WI)
... Counsel Wimmer and Sicula have met with him...nothing
definitive to report as yet.
Sen Proxmire (D-WI)
... Sicula/Czerwinski met with him in Milwaukee week of
8/10...they note he is noncommittal...8/18 correspondence to
constituents is also noncomittal.
... FYI ... At this point Brozek suggests Rep Moody and
ex-governor Tony Earl are the Democratic leaders of what
promises to be a large field seeking to replace the retiring
Proxmire.

State Governments to encourage anti-FET position similar to
that adopted by Eastern and Southern CSG conferences.

REGION V (Jacobson)
Chuck Hord, WSATCD, sent an excellent mailing to his members
on both issues 8/18.
Airlines ....
Sen Inouye (D-HI)
... Counsel Suzuki/Kimura have corresponded with the senator
during August and asked others to do likewise...Suzuki,
however, says it is unlikely that we can count on support
from Inouye. It also should be remembered that the
anti-airline smoking resolution adopted by the Hawaii
legislature this year may have an impact on the senator's
thinking.
Sen Hatfield (R-OR)
... Counsel Crawford will contact senator before the recess
ends.
... Crawford also has scheduled a meeting with members of
the Portland port authority to ask for their cooperation.
Sen McClure (R-ID)

8/17, but the senator remained noncommittal..oRoden will
speak with him again before the' end of the recess.
... Roden has scheduled meetings with the Boise airport
manager and chairman of the airport commission to enlist

Rep Chandler (R-WA)
.... In mail to constituents, Chandler continues to oppose
all tax hikes, but he is clearly anti-tobacco and will vote
for a cigarette tax hike as a part of any tax package.
Sen Matsunaga (D-HI)
Sen Baucus (D-MT)
... In constituent correspondence, Baucus continues to
express support for a tax hike.
... Counsel Anderson will speak to Baucus again immediately
following the recess...Anderson has also sent a second
letter to the entire Montana delegation regarding both the
FET and airline issues.
Sen Packwood (D-OR)
MT Reps. Williams/Marlenee
... MT Assn says both will vote a~ainst an FET hike.
Sen Nelcher (D-NT)
... MT Assn reports he would vote against an FET hike.
REGION VI (Morgan/Sutherland)
Morgan has contacted about 20 Georgia farm/other groups in
an effort to generate constitutent correspondence on both
the FET and airline issues.
Airlines ....
VA Wholesalers report they can "turn" Rep Picket's earlier
support for an airline ban should the vote occur again. The
Assn has been working contacts with the freshman rep, and he
is now aware that there is a downside to this anti-tobacco
vote. With Wolfe (R-VA) we have no solid contacts.
Sen Byrd (D-WV)

... Counsel and wholesaler allies to remain in contact with
the senator on both issues...in correspondence to counsel
Nottingham, Byrd remains noncommittal on the FET...no direct
word yet on the airline ban.
Sen Hollings (D-SC)
... Counsel Smith contacted his good friend Hollings week of
8/24. Hollings told Smith he would take the lead against
the airline smoking ban, but offered the observation that it
could cost our side votes should Helms take the lead in any
floor debate.
Sen Mikulski (D-MD)
... As of 9/11, Counsel Bereano reports that the Sen is
noncommittal but open to our view on the issue. Bereano
says this is encouraging since she traditionally £avored
smoking restriction type measures when in state government.
Bereano will continue to contact her (they meet again in
late Sept), but will not push to the point of being a
nuisance.
Week of 8/10 Sutherland spoke with Virginia Farm Bureau
executives and they agreed to contact both Warner and Trible
in opposition to the proposed airline ban...same week
Sutherland spoke with personnel at Richmond's Universal Leaf
and American Tobacco Administration headquarters, and they
agreed to generate contact with the two Virginia senators.
FET
Rep Jenkins (D-GA)
... Morgan says (week of 8/24) that the rep maintains the
position that "he doesn't like excise taxes," but adds "to
reduce the deficit it may be necessary to raise taxes."
Morgan adds that Jenkins received very favorable coverage of
his stint on the Iran panel and sees himself as "bullet
proof."
Sen Rockefeller (D-WV)
... Mail to constituents indicates the senator is still
undecided on the issue.

... Morgan met personally with his friend Staggers to ask
his general assessment of the FY88 budget debate. Like
many, Staggers believes Congress will adopt a continuing
resolution after Reagan rejects a measure loaded with tax
