Thank you very much for contactingme back regarding the"
Durbin amendment (H.R. 2890).
Your explanation for the purpose of this bill leaves me
pu~led. In your letter, 9/15/87, you stated:
• ..the aircraft filtration systems, did not eliminate
much of the smoke from the aircraft but simply dispersed
it throughout. This fact led many to the conclusion
that a two hour ban was not dnreasonable.
Common sense tell~ me that smoke would present a greater
problem for lon~er flights if the aircraft filtration system
was inadequate. Twice the cigarettes would be smoked in a 4
hour flight than a 2 hour f$ight. Perhaps the filtration system
should be improved - not inconvenience travellers even more.
While not exactly a world traveler, the past flights I
have taken were not marred by cigarette smoke. The separation
of smoking seats and non-smoklng seats seemed adequate and
reasonable. The saying, "if it's not broke.,, don't fix it,"
applies nicely to this situation.
I am interested in keeping personal choices and freedoms
alive, not reducing them with extra unnecessary laws. Let the
a~rllne personnel concentrate on safety and service not enforcing
this smoking ban. Please let me know whet can be done to rectify
this problem.

Dear Mr. Smith:
Thank you very much fo~ contacting me regarding your
opposition to the Durbin amendment.
As you well know, on July 13 the U.S. House of
Representatives passed the Durbin amendment to H.R. 2890, the
Department of Transportation Appropriations Act for Fiscal Year
1988. As adopted, the amendment prohibits the use of funds for
airport development at airports which permit commercial air
carriers to provide scheduled service permitting smoking on
flights of 2 hours or less. In effect, thethrust of the
amendment is to prohibit smoking on these short domestic
flights. It was clear that the aircraft filtration systems did
not eliminate much of the smoke from the aircraft but simply
dispersed it throughout. This fact led many to the conclusion
that a two hour ban was not unreasonable.
Again, thank you for taking the time to share your
thoughts with me on this important matter.

Once again ] am asking for your help when the alrllne smoking
btll comes before you. Last month this Issue unjustly passed
through the House. P]ease do not let it pass through the Se~ate.
For decades now, Federal aviation agencies have attempted to
pass rullngs r~garding smoking aboard aircraft. In nearly a
dozen attempts, Including exhaust|ve reviews, all proposals
to ban smoking have been rejected.
F.or you to pass this legislation would pose serious compliance
problems, and s|gntftc~nt administrative and practical problems
for alrlJnes and passengers alike.

! am askln9 for your help on an issue that ! feel is very
important. ! am a frequent flyer and also a smoker.
only am I shuffled to the back of the airplane on all flights,
but often times ! am not allowed the prlvlledge of smoking at
all. A non-smoker is always guaranteed a smoke free seat even
if a smoking section must be reduced or eliminated altogether
for that flight.
At the present this situation seldom ex|sLs and ! am generally
happy with the smoktpg policies. I understand you will be
representing the Oklahoma people on an upcoming issue which
could ban smoking on most, or all fl|ghts, This bill rec.ently
and unjustly passed the House earlier this month for flights
of less than two hours. As a frequent flyer yourself, I am sure
you will agree that the current policies on smoking are well.
accepted and lead to very few complaints. The problems we all
acknowledge are flight delays, crowded conditions, and improper
csre of luggage. Perhaps you can help us on these, matters.
