Once again this places an unfair burden on smokers. The present system of airlines having both smoking and non-smoking sections is working well with few complaints. When this smoking ban amendment leaves the Senate Appropriations Cemmittee and goes before the Senate, I ask that you vote to defeat any smoking ban form presented. Smoking aboard aircraft is already sharply restricted; every passenger is guaranteed a "no smoking" seat, even if a smoking section must be reduced or eliminated to satisfy that guarantee. A smoking ban would pose serious compliance problems and significant administrative and practical problems for airlines and passengers alike. Pelion 129 Puffin Court Royal Palm Beach, Florida 33411 Dear Lary: I appreciate your contacting me with regard to recent legislation which would ban smoking on domestic airline flights. Representa- tive Durbin authored an amendment to the House of Representa- tives' transportation appropriations bill which would specifical- ly ban smoking on flights of two hours or less, approximately 80 percent of domestic flights. The Senate Transportation Appropria- tions Subcommittee will be taking up this legislation shortly, and I hope similar or improved provisions will be included by the Senate as well. You may also be aware of Senator Hatch's bill to prohibit smoking in public conveyances, S. 51. It has been referred to the Commit- tee on Commerce, Science, and Transportation. Senator Hatch's proposed legislation would ban smoking in buses, planes, and trains and also restrict smoking to designated areas of termi- nals. It would also ban smoking in public restrooms in termi- nals. The push for a smoking ban is in part the result of recent re- search reports by the Surgeon General and the National Academy of i~, aS a ~~~:"~!~!~:~os~ every ve~k, I"S~p~¥t a ban ' on smok~n~.~n a~.~. ~ I w~ll, however, be very m~ndful of your comments on the Durbin Amendment as the Senate Appropriations Com- mittee considers this issue. Despite the fact that the existing separation of smoMers from nonsmokers has been more than suitable for years and has earned the approval of most airline passen- gers,anti-smoking forces are now tryng to impose a smo- king ban on flights of two hours or less. Your defense of the rights of smokers, in the past, is well known to me and to ot~er smokers in your district and is deeply appreciated. 'We continue to look to you to protect our constitutional rights. Nonsmokers already receive priority seating on airlines. Now they want to deprive smokers of everything. I am a smoker.
