Dear Mr. Barcome:
Thank you for contacting my office regarding your opposition to
Congressman Durbins' amendment to H.R. 2890, whichwould prohibit smoking on
aircraft not scheduled to be in the air for more than two hours. I want to
assure you that I share your concerns over this issue, and I appreciate
having the benefit of your views.
Z am concerned that a regulation such as this would be difficult, if
not impossible, to enforce. In a study three years ago, the Civil
Aeronautics Board decided that a smoking regulation such as this one would
be infeasible since it places responsibility for enforcement upon airport
administrators, people who have nothing to do with regulating airlines. In
a time of extended departure delays and near misses involving aircraft,
airport administrators are already overextended. As such, I could not
support this amendment as it w-as written.
As you may know, the amendment was passed on the House floor by a very
narrow margin. While the Senate is now considering similar legislation in
this regard, I assure you that I will continue to monitor its progress and
consider related proposals and amendments as they come up. In doing so, i
will certainly keep your comments in mind.
