This matter came on for hearing and, after review of all documents submitted
and after hearing argument from all interested parties, it is hereby ordered that
Certain Defendant's Motion for Judgment on the Pleadings pursuant to Federal Rule
of Civil Procedure 12(c) is hereby DENIED.
Plaintiffs' cause of action for wrongful death did not accrue until the day after
defendants' immunity ended. Thus, defendants are not immune from suit under
Calilfomia Civil Code ยง 1714.45. Finally, plaintifPs punitive damage claims are
adequately pleaded as arising from a survival action.
IT IS SO ORDERED.
