MEMORANDUM TO THE TORT REFORM POLICY COMMITTEE
Re: Massachusetts Medicaid t egislation
On July 10, Governor Weld signed into law legislation that authorizes the
Attorney General of Massachusetts to sue tobacco manufacturers to recover medical
assistance payments made by the Commonwealth. Attached for your review is a copy of
the statement issued by Governor Weld when he signed this legislation. The Governor
states that he is "pleased to sign this provision," but notes that it "does not significantly
alter present 1aw."
We have contacted our Massachusetts political advisors and they will be
carefully monitoring any further legislative action on this issue, as well as efforts by the
Attorney General to bring a lawsuit against the tobacco companies.
