prohibited by any other law or regulation; (B) That the proprietor
of such establishment, in accordance with rules and regulations
promulgated by the commi9sioner, certifies the indoor seating
capacity of the restaurant; and (C) That the proprietor of quch
eatabliehment poets signs at the entrance and at appropriate
locationa within the premises, indicating that amoking ia
permitted therein. An owner of a restaurant with an indoor
seating capacity of fitty patrons or fewer, who ie not otherwise
subject to the emoking restrictions of this section, may
voluntarily choose to prohibit einoking in hie or her eatablishmelat
in accordance with the provisions pertaining to restaurants with
an indoor seating capacity of more than fifty patrons, by filing a
riotice with the department in a manner and form presoribed by rule
or regulation of the department. Upon proper filing of such
