~~i ~ ~ D&W FOR IlVIlMMATE RELEASE August 10, 1995 Contact: Tom Fitzgerald 502/568-7468 Joe Helewicz 502/568-7801 LOLIISWLLE, RY- Brown & Williamson today issued the following statement regarding President Clinton's decision to allow Food & Drug Administration regulatory action against tobacco: "The Clinton Administration today aligned itself with the radical views of FDA Commissioner David Kessler and clearly set a course to ban the sale of cigarettes. Under the guise of preventing youth smoking, a goal which all tobacco companies share, the Administration in reality has laid the foundation for a 'backdoor prohibition' policy that extends not only to minors, but to adults as well. The law is clear that FDA has no jurisdiction over tobacco. For more than 80 years, Congress has repeatedly rejected proposed legislation that would have given FDA such authority. The proposed regulations, which seek to restrict cigarette sales, advertising and promotion, simply do not fit within the framework of FDA's regulatory authority. B&W believes that youth access to cigarettes can be reduced without increased government regulations. B&W agirees with many retail organizations that voluntary initiatives are best to ensure that tobacco is not sold to youth. If Kessler gets his foot in the door on the soft issue of youth access, which everyone supports, expect the agenda to expand very quickly to encompass much wider issues directly impacting the freedom of adults to make decisions about their own lifestyles. The agenda is clearly backdoor prohibition, no matter what the Clinton Administration, the FDA, the AMA or anyone else claims. We will strenuously oppose the FDA's efforts to regulate tobacco.
