After the filing of our brief, there came to
our attention the opinion of Judge Cahn iin' Edwardi J. Sweeney
and'Sons, Inc, v Texaco, Inc., dated September 4, 1979 and
reported at 162',9551of the CCH Trade Regulation Reporter.
The case is' procedurally very similar to this
action, in that it involved a directed verdict on Sherman
Act and Robinson-Patman Act claims, followed by the Court's'
own dispositionf of the claim for injunctive relief under
the Robinson-Patman Act.
One of the plaintiffs was a purchaser frosnl the
defendant,' but the other two' were not. With respect to' the
nonpurchaser plaintiffs, Judqe Cahn was therefore faced
withth~e same argument made in this case: that in spitelof
their lack of standing to' collect damages,, they could' be
entitled toequitab'lerelief . Judge Cahn dealt with, the'arg,ument as follows: `
"Mission and Petroleum purchased Texaco'
gasoline frornlSweeney on a cost-plus basis.

538). Therefore they claim to have borne
the cost of any discrimination experienced
by Sweeney. Whatever the accuracy of this
allegation, it fails to justify the granting
of an injunction on these plaintiffs' be-
half. By' plaintiffs' own admission, they
purchased the product in question from
Sweeney, not from Texaco. Thus, like the
plaintiff in Klein v Lionel Corp., 237 F.
2d 13' (3rd Cir. 1956)' , plaintiffs Mission
andlPetroleum are not purchasers within the
meaning of the Robinson,Patm'an Act. See
Kelly v General Motors Cbrp. [1977-1 TRADE'
CASES 1161287]', 425 F'. Supp. 13, 20' n. 6
(E~.. D. Pa. 1976). They are not entitled to
any relief whatsoever in this lawsuit."
