Subcommittee's letter of'
March 21 will bedelayedbe~cause~ of your preparations for y'our~
Annual' meeting.. Subcommittee staff has been, informed' that the
Annual meeting, will occur today, and so I request that you
respond to the Subcommitteen's March 21 letter, by May 18, 1989.
The Subcommittee's letters of January 25 and March 21
focused on particular brands of cigarettes appearing,in movies.
The Subcommittee wishes to broaden its inquiry to consider the
payment or providing of' valuable props to have general smoking
scenes in movies or television programs even if the scene does
not identify a particular brand'of cigarette. Accordingly,
please supply the following information by May 27, 1989:
(,1) Please list each film or television program' made since
January 1, 1979 and shown in the United States (whether made in
the United States or, iin a foreign country) for which Philip
Morris (or any of its foreign subsidiiiaries)'-directly or
indirectly (fmr example, through the' Tobacco Institute) paidd
money or supplied' props (such as billboards) in order to have a'
smoking scene appear inlthe film or television program;this
requests, includes, but is not li'mi'tedl to, having a performer or
host on a television program smoke during the program.
(2) For each film or program listed in (1), please indicate:
(a), the sum of'money paid by Philip Morris, (b) if props were
supplied', diescribe them' and provide an estimate of their, tairr
market value, (c) the company producing the film or program, (d)'
the name, address, and telephone number of the employee of the
producer of the film or prograsl with whom' Philip Morris
principally negotiated concerning the smoking scene, (e) whether
the script of the film, o'rprogram wasallteredtoincl.udea,
smoking scene, (f) whether the agreement between Phili'p, Morris
and the company making the film or program restricted in, any way
the company's ability to edit the smokin% scenes, and (g) the
diate that Philip, Morris and the company making the film or
program agreed there would be a smoking scene..

copy of the agreement between Philip~ Morris and the company
