Your letter raises further questions about the statement in the winter 19'8 issue of Philip Morris Magazine that a ban on tobacco advertising "becomes, in, the reality of the filmmaking marketplace, a pervasive ban on scenes in which tobacco products are used." You state (at 1) that "when approached by filmmakers Philip, Morris U.S.A. has occasionally provided free cigarettes and promotional materials such as brand-name signs, and in a few instances apparel promoting the film."' You go on to say (at 2) that "'Since19'79,, Philip MorrisU!.S'.A,. ha ,07 ,"~,`~p~ductsor signage for an average of 17'films per y r." The Subc mmittee requests that for each such film since anuary 1, 1987~ou provide: (ai) the name of the filim, (b" he approxima.t'e diate of the request by the filmmaker, (c) a brie 'descri on of the product or signage supplied, (d) an estima the fair market value of the product or signage supplied, and! (e), a copy of any agreement (or if no agreement, all correspondence) between Philip Morris and the filmmaker. You further state (at 2) that "based upon, our rewiew thus far"' (emphasis added) you found two movies for which Philip Morris (or its agents) paid money to have a cigarette appear inn the movies "Superman II" in 1979 and "License Revoked"'in 1988. The Subcommittee would, of course, like to know if you discover any other movies which would be responsive to my letter of January 25 (as clarified by Mr. Cohen's letter of'February 101). OD The Subcommittee wishes to better understand how you have ~ conducted your review in order to form a judgement as to whether C there may in fact be other movies for which Philip Morris (or its C03 agents) paid to have a tobacco product appear in the movie. Please provide a copy of'all agreements between Philip Morris and the other company concerning Lark sales inithe U. S. and' iniforeign countries. The autumn 1988 issue of Tobacco iYouth 1Re o~r~ter asserts that the following cigarettes made by Phl,lip Morris have appeared! in recent movies: Marlboro in "Crocodile Dundee,"' Children of'a Lesser God,111 "'Tin Men," "White Knights," "Baby," "Crimes of the H'eart," and "Risky Business;" and Benson and'Hedges, in, "Agnes of' God.," The Subcommittee requests the following information for eachh of these eight movies,: (1), Did Philip Morris (including any of its foreign companies or agents) provide cigarettes, any promotional material, or money in connection with its cigarette appearing in the movie?' (2') If the answer to the.question (!1)~ is "yes" for any of these movies,, please indicate!the amount of' money or the estimatedf~airmarlket value!of the cigarettes or promotional material and a description of what was supplied and provide a copy of the agreement (or, if no agreement, all correspondence) withithe f ilmmaker. (3) If the answer, to question, (l) is "no" for any! of these movies, please offer any explanation you may have as to how these Philip~Morris cigarettes,happen to appear in the movie.
