The Subcommittee on Transportation and Kazardous Materials,
pursuant to Rules X'and X'I'of the Rules of the United States
Nlouse of Representatives, is sesponsibYe for overseeinq the
adequacy and implementation oflaws adainistered by the Federal
Trade Commission, including the Federal Cigarette Labeling and
1ldvertisinj, Act. In order to do so, the Subcommittee has been
isiwesti''q,atinq various forms of advertisinq by, ciqarette
companies. Enclosed is a copy of the applicable portions of the
Rules of the House of'Representatiwes relating to the
jurisdiction of the Committsr on Energy and Commerce and of the
Subcommittee on Transportation and Hazardous M'atsrialia.
As part of the Subcommittee's review, in January 19819 we
requested imformation from each oflthe six cigarette companies on
whethar, they paid money or supplied val~uable props to filmmakers
on eondition that a particular ciqarette appear in the movie.
Lut ponlb Philip Morris toldi the Subcommittee that in the
fall of tlp, its representative aqxead to pay $3150, 000 to have
Lark ciqa-1t e appear in a new James Bond aevie, which will be
distribuote' tbis summer by un,ited.Artists. Philip Morris also
told us that in 1974 it pa idlal3out i4Z, S00 to haws its Marlboro
cigarette appear in the movie Su i2i. Liqgett told the
Subcommitter last sonth that in, 1983 it paid $30,000 to have its
ive ciqarette appear In the movie So~tae~.
The dotalls of the two Philfp M'orris aqre*ments are set
forth in the anclosed contracts., Ligqatt told the Subcommittee
that its aqroament was oral.

4(a) ('3) of ' the Federal Ciqarette L.abeling, and Adwertising Act.
("F= Agt")~, 15 ' USC 1333(a),(2)1, provides, in pertinent, part,

cigarettes toadWartise or, cause to be advertised(~other than
throtsQh the usr of outdoor bil lboards) within th., United States
any cigarett& unless the advertisinq bears, in ucordance with

Pederal' law also prohibits the shoving of cigarette
ad'vertisements on te1'ev:sion. Section 6 of the FCLA Act,, 115 ' tr'.SC
133S, provides "After Jan;rary 1. 1971, it shall be unlawful' to
advertise cigarettes and' little ci'gars, on any medium of
electronic communicat'i©rr sublect to the j'urisd'iction of the
Federal Vommun~icat ionsCommission."
Nhi2s the FCLA Act contains no definition of "advertise,"
the dictionary defines an advertisemant as "a notice devYqned to
attract public attention or patronage."' I believa that paying to

It, is a federal crrse to violate anyprovisionof the FCiA
Act. Section 10 of the. /'CtJ1 Act, 15 USC 1133t, provides that
"'(aJny person who vi'olates tne provisions of thi's Act shall' be
guilty of aaisdemsanor and shall on, conviction thereof be
sttloject, to a titla of not sore than, $10, 0100."
