COME NOW plaintiffs and complain of defendants, and each of them, as follows:
JURISDICTION, PARTIES AND CAPACITIES
Jurisdiction and Intradistrict Assignment
1. Plaintiffs bring this action pursuant to the provisions of Title 42 of the United
States Code, sections 1981, et seq., Title 28 of the United States Code, section 2201, and Rules
23(b)(1) & (2) of the Federal Rules of Civil Procedure to secure a declaration by this court that
that certain contract commonly referred to as the "Master Settlement Agreement" entered into by
the defendants named herein, and the defendant classes and subclasses alleged herein, and the
conduct of defendants in entering into the Master Settlement Agreement, and implementing it, is
unconstitutional, invalid, and violates the civil rights and liberties of plaintiffs, and the
plaintiff
classes and subclasses alleged by them herein. Plaintiffs also seek an injunction and writ
restraining defendants from further implementing, carrying out or enforcing the Master Settlement
Agreement and for damages, all as is more fully alleged hereinafter.
2. This action is properly filed in the San Framnco division of the court because of the
pendency of a related action herein (see Notice of Related Action filed herewith) several plaintiffs
reside within the City and County of San Francisco, the City and County of San Francisco is a
defendant, and defendants State of California, the Attorney General of the State of California, and
the Department of Health Services of the State of California maintain principal places of business
within the City and County of San Francisco.
