Accordingly, I am sending herewith nine copies of the Aqreement (without exhibits) to Arnold Henson for execution by an authorized officer on behalf of American Brands, Inc. As each company so executes the Agreement, all copies should be sent to the next company in the order in whichithe names appear as signatories to the Agreement. When all copies have been signed and dated by all companies, they should be returned to me: I will then~attach the Exhibits and proceed to obtain Harvard's execution of the Agreement and the Covenants Not To Sue. 0;;" 7•s9~i,~'14 I have received checks from American and Lorillard for their shares of the settlement amount. At this time, I would request checks from the other companies in their respective amounts payable to "The President And~Fellows Of Ha'rvard College For The Benefit Of Harvard Medical School." (Schedule of amounts is enclosed.) After Harvard has executed and delivered the Agreement and the Covenants, I will deliver the companies' checks to Harvard. ,

After Harvard has received the settlement amount, which includes the amount due ARRCO, it will issue its check to ARRCO for which I will obtain the releases. When these matters have been concluded, I will forward to each company an executed copy of the Agreement with Exhibits, the Covenant Not To Sue executed by Harvard, and a copy of the Release executed~by ARRCO. ~ I appreciate your cooperation in expediting the execu- tion of the Agreement.
