JOHNSTON JAMES N.OTTMAN OF COUNSEL DAVI'D~R, i 19I7-1976 Re: Harvard Project Equipment Gentlemen: The purpo se of thi s letter i s to upd'a te you on the equipment so you can begin to consider a final disposition. Dr. Huber is compiling an inventory of the research equipment and other files and' materials relating to the Harvard Project ("the property"). Most of the items are located in Lexington, Kentucky, either at the Tobacco and Health Research Institute or in a storage facility there. Additional equipment and files are still located at a storage facility in Boston. Also, a 1977 Fiat station wagon, purchased for the Project, is in a garage at Harvard. When Dr. Huber took the position of Director of the Kentucky Tobacco and Health Research Institute, the Institute (or the University of Kentucky) paid shipping expenses on the portion of the property which was shipped to Lexington. At that time it was expected that all of the property would ultimately be shipped to the Institute. Since then, as you know, circumstances have changed and Dr. Huber is no longer Director of the Institute. I have recently received correspondence from the Associate Director of Administration for the Institute requesting a resolution of ownership of the equipment. In this regard', the Institute is not claiming ownership'of the property, but would like to use certain items of equipment presently located at the Institute for its research.

. y r k SHOOK, HARDY & BACON August 27, 1982 Page 2 Dr. Huber has retained his tenured position on the staff of the Departments of Medicine and Anatomy at the University of Kentucky. Through the Department of Medicine, he has an opportunity to continue research~in the smoking and health area. He will be provided with space and some funding for research and would'like to have access to the property for this purpose. In addi~tion, Dr. Huber has expressed an interest in using the property if he leaves the University of Kentucky and'relocates at another institution. Dr. Huber is in the process of preparing a recommendation for disposition of the property. V I will send the inventory and Dr. Huber's recommendation as soon as they are received.
