KENTUCKY 40506 TOBACCO AND HEALTH RESEARCH INSTITUTE October 05, 1982 Honorable Lee E, Stanford Shook, Hardy & Bacon Mercentile Bank Tower 1101 Walnut Kansas City, MO 64106 Dear Mr. Stanford: V Early in September, following your letter of August 23, 1982, I received a somewhat spurious communication from Gary Huber, former Director of the Tobacco and Health Research Institute, regarding the Harvard program inventory currently located at - THRI. In his cUrrespon- dence, Dr. Huber intimated that the inventory list provided by THRI may have been improperly manipulated here and that he had "so informed the industry grantors." He did not bother to advise us in what manner our inventory list was "inaccurate and/or erroneous." After asking our people to again spot check every lab and storage area in this facility, additional items which may relate to the Harvar& Program inventory were discovered and they have been added to the previous list. As best I am able to determine, Huber had various Harvard project items transferred into this facility in a piecemeal fashion and we have been in the position of having to create an inventory list. I talked this morning with Mr. Val Pochay, Huber's former assistant, and he conf irmed that no separate inventory was ever prepared for these.items while Huber was here. The bottom line is this, Mr. Stanford, Dr. Huber is no longer associated with THRI. Nor, to my knowledge, does he own any of the equipment with which we are concerned. In short, we have neither the desire nor the intention of dealing further with Dr. Huber. It seems amply clear to me that if Huber had any geniune interest in trying to help resolve this matter, it would have bemresolved some time ago. He was provided an inventory list as early as June of this year, and yet he declined to question its accuracy until September. He still has made no effort to clarify the list for us and we are in the unacceptable position of having to hunt for the items he ha&located here. .

S_inford October 05, 1982 Page 2 - ( In hopes of finally concluding this matter, I would like to advise that THRI, through the University of Kentucky, would be most grateful to accept as a gift those items listed in the attached inventory, all of which are located in the THRI facility. We are not in a position to retain the items on loan due to fiscal considerations regarding their repair, upgrading and/or annual maintenance. If the industry grantors do not feel inclined to make such a gift at this time, we understand fully, and will ready the inventory so that it can be available to your people in a manner conducive for shipping. I regret the confusion and inconvenience this entire matter may have caused you and the granto"rs. Quite obviously, it was neither the intent nor the desire of the University to become involved in the unfortunate mess which followed Dr. Huber's brief attempt at adminis- tration of THRI. My judgment suggests strongly that the best interests of THRI require that we resolve this matter one way or the other in the near future. To-that end, may we establish November 15 as a date for con- cluding whether the grantors wish to transfer the items in question to- THRI or recover them for whatever purposes they deam appropriate?
